COMMISSION RESOLUTION NO. 4177
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, REGARDING A TRACT OF LAND COMMONLY KNOWN AS
CENTENNIAL PARK, BEING 4.8709 ACRES IN SIZE AND CONSISTING OF
BLOCKS 37 AND 38, INCLUDING THEIR VACATED ALLEYS AND PORTIONS OF
VACATED ASPEN STREET AND WILLSON AVENUE, IMES ADDITION,
DECLARING SAID TRACT OF LAND TO BE PUBLIC PARK LAND.
WHEREAS, The subject property is owned by the City of Bozeman; and
WHEREAS, Section 7 -16 -4101 Montana Code Annotated authorizes municipalities to
establish, alter, and maintain parks; and
WHEREAS, The subject property has been developed and maintained by the City of
Bozeman as public parkland; and
WHEREAS, The subject property is utilized by the public extensively and exclusively
for park purposes; and
WHEREAS, The subject property was not formally dedicated as parkland through a
subdivision and platting process; and
WHEREAS, The Commission finds that formally declaring Centennial Park public
parkland would be in the community's best interest, to help ensure that the property continues to
be owned by the public and managed as public parkland; and
WHEREAS, Formally declaring Centennial Park public parkland would advance the
goals and objectives of the adopted Parks, Open Space and Trails (PROST) Plan, which states
the City's parks, recreation programs, and facilities, open spaces and trails play a vital role in
defining Bozeman as "the most livable place;"

NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana:
Section 1
That pursuant to Section 7 -16 -4101 MCA, Centennial Park, as described above and as
shown on Exhibit A (attached), is hereby declared to be public parkland to be utilized by
the citizens of the City of Bozeman, Montana pursuant to and consistent with various
ordinances of the City of Bozeman.
Section 2•
That City of Bozeman staff shall take such steps as necessary to ensure a public record of
this action is recorded with the Clerk and Recorder's office of Gallatin County, Montana,
so that this Declaration of Parkland is known to all men and women as the will of the
City Commission of the City of Bozeman, Montana.
PASSED AND ADOPTED BY THE City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 6` day of July, 2009.
