ORDINANCENO1500ANORDINANCEOFTHECITYCOMMISSIONOFTHECITYOFBOZEMANMONTANAESTABLISHINGPROCEDURESFORTHEADMINISTRATIONOFTHEMUNICIPALZONINGORDINANCEWITHINTHECITYLIMITSTOACCOMMODATETHEANTICIPATEDCEDEOFZONINGAUTHORITYINTHEEXTENDEDJURISDICTIONALAREAOFBOZEMANFROMTHECITYOFBOZEMANTOGALLATINCOUNTYTOREMOVEREFERENCESTOTHEFORMERBOZEMANEXTRATERRITORIALAREATOREMOVETHEPLANNINGBOARDASTHEZONINGCOMMISSIONTOESTABLISHAZONINGCOMMISSIONTOINCORPORATECHANGESINSTATEZONINGLAWANDTOCORRECTVARIOUSERRORSINTHEEXISTINGORDINANCEPreambleThisordinanceistoprotectthepublicpeacepropertyhealthandsafetythroughtheadoptionasanurgencymeasureofanemergencyinterimzoningordinanceestablishingproceduresfortheadministrationofthemunicipalzoningordinancewithinthecitylimitstoremovereferencestotheformerBozemanextraterritorialarearemovetheplanningboardasthezoningcommissiontoestablishazoningcommissiontoincorporatechangesinstatelawandtocorrectvariouserrorsintheexistingordinanceThisemergencyinterimzoningordinanceisnecessarytoaccommodatethedissolutionoftheCityCountyPlanningBoardandtoensurethecontinuationofmunicipalzoningWHEREASonthe21stdayofAugust1957theCityCommissionadoptedOrdinanceNo820creatingtheCityCountyPlanningBoardandWHEREAStheGallatinCountyBoardofCommissionershastakenactiontodissolvetheCityCountyPlanningBoardandestablishplanningandzoningjurisdictionwithintheareaimmediatelybeyondthemunicipalboundariesoftheCityofBozemanwhichareaiscurrentlyregulatedbytheCityofBozemanandWHEREAStheBozemanMunicipalCodeneedstobereconciledwiththenewCountylegislationandWHEREASthereferencestotheauthorityoftheCityofBozemantoexersizezoningcontroloutsideofitsmunicipalboundariesarenolongerapplicableandneedtoberemovedandWHEREAStheCityCommissiondesirestomakeproceduralchangestothereviewofzoningapplicationsandWHEREASSection762306MontanaCodeAnnotatedprovidesforadoptionofaninterimzoningordinancewhichimposesregulationsonusesinsupportofacontemplatedpendingzoningplanorzoningchangeandWHEREASinadditionSection734326MontanaCodeAnnotatedallowsfor adoptionofanemergencyordinancefortheimmediatepreservationofpublicpeacepropertyhealthorsafetyNOWTHEREFOREBEITORDAINEDbytheCityCommissionoftheCityofBozemanMontanathatSection1ThatTitle18oftheBozemanMunicipalCodebereplacedbyaninterimzoningordinanceandthattheinterimTitle18shallreadasfollowsSeeExhibitASection2ThattheofficialzoningmapreferencedinChapter1806BozemanMunicipalCodeandauthorizedbySection763202MontanaCodeAnnotatedbereplacedbyaninterimzoningmapandthatsuchmapshallbeasfollowsSeeExhibitBSection3RepealerAllresolutionsordinancesandsectionsoftheBozemanMunicipalCodeandpartsthereofinconflictherewithareherebyrepealedSection4SeverabilityIfanyprovisionsofthisordinanceortheapplicationthereoftoanypersonorcircumstancesisheldinvalidsuchinvalidityshallnotaffecttheotherprovisionsofthisordinancewhichmaybegiveneffectwithouttheinvalidprovisionorapplicationandtothisendtheprovisionsofthisordinancearedeclaredtobeseverableSection5SavingsProvisionThisordinancedoesnotaffecttherightsofdutiesthatmaturedpenaltiesandassessmentsthatwereincurredorproceedingsthatbegunbeforetheeffectivedateofthisordinanceSection6EffectiveDateThisordinanceshallbeinfullforceandeffectuponactionoftheGallatinCounty2 CommissiontoadoptzoningauthorizedbySection762201MontanaCodeAnnotatedwithintheareapreviouslyknownastheBozemanExtraterritorialZoningJurisdictionPASSEDADOPTEDANDAPPROVEDbytheCityCommissionoftheCityofBozemanMontanaataregularsessionthereofheldonthe19thdayofJuly1999jtMARCIABYOUYOrATTESTjJROBINLSULLIVANClerkoftheCommissionAPPROYDASTOFORM3
