WHEREAS, on the11" day of August, 2003, the City Commission voted to adopt
Resolution No. 3611 which created the Community Alcohol Coalition (Coalition) and
WHEREAS, on the 201h and 27th of October, 2003, the City Commission appointed
members to serve on the Coalition; and
WHEREAS, the first order of business of the Coalition was the consideration of
bylaws and election of officers; and
WHEREAS, the Coalition voted to adopt those bylaws as contained herein:
NOW, THEREFORE, be it resolved that the Bylaws of the Community Alcohol
Coalition read as follows:
ARTICLE I - CREATION
The Bozeman Community Alcohol Coalition, hereinafter referred to as the Coalition,
was created on the 11`h of August, 2003, by City of Bozeman Resolution No. 3611.
ARTICLE II - OBJECTIVES
The CAC shall examine additional policy strategies for the health and safety of
Bozeman residents to prevent underage and high risk drinking behaviors, and their
associated impacts, and make appropriate recommendations to the Commission
concerning these strategies; as well as advise the Commission or staff as needed in
regard to the policies and programs recommended by the Bozeman Alcohol Policy
Advisory Council and endorsed by the City Commission, when they are implemented.
ARTICLE III - POWERS AND DUTIES
The Council shall have the following duties and responsibilities:
A. Policy and Strategy Issues. The Bozeman Community Alcohol Coalition shall
make recommendations concerning all pertinent issues regarding the health and
safety of Bozeman residents with regard to prevention of underage and high risk
drinking behaviors and associated impacts. In order to do this, the Coalition will
meet as necessary to review information and conduct appropriate research, and
develop a consensus concerning policy and action available to the City
Commission. The Coalition will make presentations to the Commission, the City
Manager or his designee regarding these issues and their recommendations, if any.
B. Policy and Program Implementation Recommendations. The Coalition shall,
upon the request of Coalition officers or the Commission, review draft ordinances
prepared to implement the policy and program recommendations made by the
Bozeman Community Alcohol Coalition Bylaws p. 1 of 6
Bozeman Alcohol Policy Advisory Council and approved by the Commission in April
2003 to ensure the drafts fulfill the intent of the Council's recommendations. If for
legal reasons any of the proposed ordinances are determined to be unfeasible, the
Coalition may research and recommend alternative solutions oradditional strategies
to increase public safety in lieu of a particular ordinance. The Coalition shall also
workwith Citystaff, elected officials, non-profit groups, neighborhood organizations,
schools, and businesses to oversee, assist, and evaluate implementation of the
ordinances, upon adoption. Implementation activities may include, but not be limited
to, program development, public information workshops, training sessions, events
intended to increase public awareness of the public health and safety issues
addressed by the ordinances, media relations, brochures, and educational
materials.
ARTICLE IV - MEMBERSHIP
A. Appointment - Terms
1. That the "Community Alcohol Coalition" shall consist of fifteen (15)
members to be appointed by the City Commission. Members of the Coalition
shall be appointed so that the membership shall be represented as follows:
a. Three Hospitality Industry Representatives from any of the
following areas, but only one per area identified:
Bar or Tavern Owner/Manager; Restaurant Owner/Manager,
Alcohol Distributor,Tavern Industry Association, Off-site Retail
Sales, Hotel/Motel management (with alcohol on-site)
b. Two members of law enforcement, one member to be from the
Bozeman Police Department and the other selected from a list
of interested candidates submitted by the Director of Public
Safety which may include Gallatin County Sheriffs Officers,
Montana Highway Patrol Officers, and Montana State
University Police Officers
C. Two Prevention Specialists
d. A Montana State University-Bozeman student with an interest
in health prevention (this position shall be appointed for a one
year renewable term so long as the person remains qualified
for this appointment)
e. A Montana State University-Bozeman faculty or staff member
f. A Bozeman Senior High student (this position shall be
appointed for a one year renewable term so long as the person
remains qualified for this appointment)
g. A Bozeman School District Representative,who is not already
involved in prevention issues but is involved in policy-making,
h. An Emergency Room Physician
i. A local Business Person who is not in the hospitality industry
j. A Neighborhood Association Representative
k. An interested citizen who may or may not qualify in another
capacity

2. Except for student members, members shall serve three (3) year
staggered terms unless otherwise specifically noted, with terms to end on
June 30. Each member may be reappointed without any limitation on the
number of reappointments. Vacancies shall be filled in the same manner as
original appointments for the balance of the term remaining. At the time of
first appointment, the Commission shall designate the initial term, splitting
the appointments evenly between 1 year, 2 year and 3 year initial terms.
B. Qualifications
All persons of legal age, with the exception of the High School student
representative, are eligible for consideration within the above categories and may
be appointed to the Coalition. A majority of the members shall be residents of the
city. Members who do not live within the city limits shall have a tangible connection
with the city by virtue of working in the city, or owning property in the city.
C. Compensation - Expenses
The City shall pay only the expenses of the Coalition which have been
authorized by vote of the City Commission prior to said expense being incurred.
Members shall serve without compensation for their time and services.
D. Resignations and Vacancies
Resignations from the Coalition shall be submitted in writing to the City
Commission, with a copy of the letter to be sent to the Chair.
E. Removal from Office
1. Any appointee maybe removed from office by a majority vote of the City
Commission.
2. Three (3) unauthorized consecutive absences from regularly scheduled
Coalition meetings shall be grounds for removal of a member of the
Coalition. Absences shall be authorized by the Chair.
F. City Commission Liaison
One member of the City Commission shall be assigned as a liaison to the
Coalition and may attend meetings of the Coalition, schedule permitting. An
alternate from the Commission may also be appointed. This Liaison member
will act as a conduit between the Coalition and the City Commission and
provide a contact for the Coalition.
ARTICLE V - OFFICE OF AGENCY, STAFF SUPPORT
The City may assign one or more staff members to the Coalition. These staff
members shall be ex-officio members without vote, but may serve as either advisors or as

resources for the Coalition. These staff members may attend meetings of the Coalition,
schedules permitting.
ARTICLE VI - OFFICERS AND THEIR DUTIES
A. The Coalition shall elect from its voting members a Chair, Vice Chair and
Recording Secretary at its first regular meeting of each fiscal year.
B. The Chair shall preside at all meetings of the Coalition and shall exercise the
duties normally conferred by parliamentary procedure on such officers. The Chair
may call special meetings and generally perform other duties as may be prescribed
by the Coalition or the City Commission. The Chair shall initiate items for
discussion and recognize all matters brought up for discussion before the Coalition.
C. The Chair, Vice Chair and the Recording Secretary shall continue to serve as
voting members of the Coalition following their election.
D. The Vice Chair shall have the authority to act as Chair in the absence or
disability of the Chair.
E. In the absence of the Chair and the Vice Chair, the members of the Coalition
shall select an Acting Chair.
F. The Recording Secretary shall be responsible for taking, preparing and
distributing the minutes of all meetings. In the absence of the Recording Secretary,
the Chair shall appoint any member present to act in the capacity of Recording
Secretary. One copy of the minutes shall be filed in the Office of the Clerk of the
Commission, which copy shall be the official approved minutes of the Coalition and
shall be submitted following the meeting at which the minutes are approved.
G. The Coalition officers will function as a subcommittee to review draft ordinances
prepared to implement the policy and program recommendations made by the
Bozeman Alcohol Policy Advisory Council and approved by the Commission in April
2003 to ensure the drafts fulfill the intent of the Council's recommendations before
public hearings and Commission action. The officers will keep the full Council
informed and ask for their input as needed.
ARTICLE VII - MEETINGS
A. Schedule of Meetings
The Coalition shall hold regularly scheduled meetings as frequently as
necessary to fulfill its function and not less often than quarterly. The regular
meeting place of the Coalition shall be in the City Commission Room in City Hall,
located at 411 East Main, Bozeman, Montana.

B. Special Meetings
The Chairman of the Coalition,the staff person assisting the Coalition, or any
two members of the Coalition may call special meetings of the Coalition as needed.
C. Quorum
A majority of the voting members (8 of 15) shall constitute a quorum.
D. Open Meetings and Documents
All meetings of the Coalition shall be open to the public, and its documents
shall be open for inspection and review during regular business hours of the City.
Reasonable public notice shall be given prior to meetings.
E. Rules of Order
Meetings of the Coalition shall be conducted according to all applicable rules
and regulations of the City of Bozeman and according to Robert's Rules of Order,
unless otherwise specified in these Bylaws. A voting member of the Coalition orthe
City staff person assisting the Coalition may be designated by the Chair to serve as
parliamentarian. No action of the Coalition is official, however, unless authorized
by a majority of members present at a properly called meeting at which a quorum
is present.
F. Conflict of Interest
Coalition members shall be bound by all applicable provisions of the Code
of Ethics contained in Chapter 2.01 of the Bozeman Municipal Code. All members
who feel they may have a conflict of interest with regard to a specific item shall
inform all other Coalition members and shall not participate in either the vote or the
discussion on that item. In the event of disqualification due to a conflict of interest,
such fact shall be entered into the minutes of the meeting.
ARTICLE VIII - OPERATING POLICY/DISCRIMINATION/ADA
The Coalition and its members shall comply with §49-3-205 Montana Code
Annotated along with all pertinent amendments as well as any federal regulations
regarding discrimination.
ARTICLE IX - AMENDMENTS
Bylaw amendments may be introduced in writing by any member of the Coalition at
a regular meeting. Action by a majority of the Coalition on the amendments may be taken
on second reading at any future regular meeting. Bylaws shall not be amended in conflict
with City of Bozeman policies or ordinances; and the City Commission shall be provided
with informational copies of bylaw amendments.

Bylaw amendments, once adopted by the Coalition, shall be forwarded to the Clerk
of the Commission for inclusion in the official bylaws, and the official bylaws and all bylaw
amendments shall then bear the signature of the current Chair.
