LINKED MINUTES OF THE SPECIAL MEETING OF THE CITY COMMISSION
BOZEMAN, MONTANA

The Commission of the City of Bozeman met in the Commission Room, City Hall at 121 North
Rouse on Thursday, November 12, 2009. Present were Mayor Kaaren Jacobson, Cr. Sean
Becker, Cr. Eric Bryson, Cr. Jeff Rupp, City Manager Chris Kukulski, Assistant City Manager
Chuck Winn, City Attorney Greg Sullivan, and Deputy City Clerk Aimee Kissel.

Mayor Jacobson called the meeting to order at 12:04 p.m.

Mayor Jacobson opened public comment.
0:01:46 Deedee Taylor, Public Comment
Ms. Taylor of 8 West Harrison Street, announced a three day exhibit at the Story Mansion of
Paul Heaston's drawings of Main Street sponsored by the Downtown Bozeman Partnership, the
Montana State University School of Art and the Friends of the Story Mansion.

0:02:48 1. Application for House Bill 645 Historic Preservation Grant for Story
Mansion (Rosenberry)

Mr. Sullivan explained that Cr. Rupp needs to speak before the staff presentation.

Cr. Rupp said that on Monday, November 9, 2009 when this action item was originally
considered, Cr. Rupp recused himself from the decision making process because of a conflict of

interest. On Tuesday, November 10, 2009 he sent a letter via e-mail and hard copy to the
Commissioner of Political Practices to disclose his conflict of interest due to his employer
submitting a grant application for the same funding source. He can now participate in the
discussion today.

Ms. Meyer gave the staff presentation on this item.
0:10:19 Allyson Bristor, Assoc. Planner and Historic Preservation Officer
Ms. Bristor provided information asked by Cr. Becker when this item was originally discussed
on November 9th regarding the manner in which the sprinkler system and landscaping contribute
to the historic nature of the site.

0:12:36 Motion and Vote to authorize the absence of Cr. Krauss.
It was moved by Cr. Becker, seconded by Cr. Rupp to authorize the absence of Cr. Krauss.
Those voting Aye being Crs. Becker, Rupp, Bryson and Mayor Jacobson.
Those voting No being none.
The motion passed 4-0.

Cr. Rupp asked questions regarding the ice damming on the Story Mansion and what it would
take to fix it.

Mr. Winn answered Cr. Rupp's question explaining that the ice damming problem is being
caused by the lack of insulation in the attic space.

Cr. Rupp continued the conversation and questions regarding ice damming.

Cr. Rupp asked Ms. Bristor what involvement the Historic Preservation Board has had in this
process.

Ms. Bristor explained that Ms. Kramer is the staff liaison for the Historic Board so Ms. Bristor
has been providing Ms. Kramer with updates as this application has gone through the process,
but the Historic Preservation Board has not actually formally reviewed the application.

Mayor Jacobson asked if there were other city owned properties that were eligible for these
funds.

Ms. Bristor said there are two other city owned historic properties but they have both undergone
rehabilitation projects recently.

Cr. Rupp said all historic projects could benefit from this grant including privately owned.

Ms. Bristor said the grant was discussed with the Osborne Block Building owner and
information on applying for the grant was given to the owner.

Mayor Jacobson opened public comment.
0:19:34 Jane Klockman, Public Comment
Ms. Klockman of 713 South Willson spoke on behalf of the Friends of the Story Mansion. She
said that they have been asked to provide letters of support from the community for this
application. She emphasized their understanding of, and interest in the economic considerations
in this application saying the insulation work would provide some construction jobs now and
would save money to City residents and would protect the cities investment.

Ms. Taylor of 8 West Harrison Street spoke in favor of submitting the application for the roof
and spoke to the problems surrounding the roof not being addressed previously.

Seeing no further public comment, Mayor Jacobson closed public comment and the public
hearing.
0:25:20 Motion to authorize the City Manager to sign House Bill 645 preservation grant
application for the Story Mansion with the following priorities in that grant: 1st insulation,
which will take care of the second concern, ice damming (2nd priority), 3rd the roof, 4th
sprinkler system, 5th sidewalk.
It was moved by Cr. Rupp, seconded by to authorize the City Manager to sign House Bill
645 preservation grant Application for Story Mansion improvements with the following
priorities in that grant: 1st insulation, which will take care of the second concern, ice
damming (2nd priority), 3rd the roof, 4th sprinkler system, 5th sidewalk.

Mayor Jacobson began discussion on the motion.

Cr. Bryson spoke regarding his views on this item and his rationale and his frustration with
seemingly contradictory information on this item.

0:35:49 Motion to approve the grant application with the following list of priorities: #1
$25,000 in insulation and #2 $141,508 in roof repairs.
It was moved by Cr. Bryson, seconded by Cr. Rupp to approve the grant application with
the following list of priorities: #1 $25,000 in insulation and #2 $141,508 in roof repairs.

Cr. Rupp spoke to his frustration that the Historic Preservation Advisory Board was not
consulted in this grant application process.

Cr. Becker made a clarifying point for the record saying this is an effort aside from any of the
costs that would be paid back by the Friends of the Story Mansion to make the general fund
whole, nor will it apply towards that amount.

priorities: #1 $25,000 in insulation and #2 $141,508 in roof repairs.
Those voting Aye being Crs. Bryson, Rupp, Becker and Mayor Jacobson.

0:41:54 1. Response to question from Monday Nov. 9th regarding trail installation
Mr. Kukulski responded yes to a question asked on Monday, November 9th from Cr. Rupp
regarding whether a trail was installed according to the standards we indicated.
0:42:07 2. Item on Next Monday, November 16th agenda regarding the process for
hiring a new Police Chief and Planning, Community Development Director
Mr. Kukulski asked Commissioners to continue thinking about what they would like to see in
these two critical positions for discussion next Monday.
0:42:56 3. Cr. Rupp absent for the November 16th Commission meeting
Cr. Rupp said he would be gone for the November 16th Commission meeting.

0:43:02 4. Two issues from Montana Fair Housing Group regarding handicap
compliance and regulating family sizes
Cr. Rupp brought up two issues the city is facing from the Montana fair housing group. He said
the first one deals with handicap compliance issues and the second he would like to see on an
action agenda and infringes upon the local governments’ ability to protect their neighborhoods in
terms of regulating family sizes / determinations, number of people living in a residence. He
would like to encourage strongly advocating for our position.

Mr. Sullivan said these are administrative, adversarial proceedings fought against the city that
are being handled by Tim Cooper. He gave a brief update on these issues and said that if the
Commission so chose, these could be discussed at an upcoming meeting.

Cr. Rupp said as we begin to negotiate he would like the attorneys to know how the Commission
stands.

Mr. Sullivan said a legislative process is needed to change the zoning in question. The
Commission would at that process need to decide whether they would amend or not amend the
Unified Development Ordinance.
