HomeMy WebLinkAboutRequest from D & D Palmer LLC for a Six Month Extension to Woodhaven Village PUD.pdf Report compiled on December 17, 2009 Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Doug Riley, Associate Planner Andrew Epple, Director, Planning and Community Development Chris Kukulski, City Manager SUBJECT: Woodhaven Village PUD – Final Site Plan- Six Month Approval Extension - #Z-07005 MEETING DATE: Monday, December 28, 2009 AGENDA ITEM TYPE: Consent RECOMMENDATION: That the City Commission approve the request from D & D Palmer LLC for a six month extension to the Woodhaven Village PUD – Final Site Plan approval as allowed under Section 18.36.060.B.2 of the Bozeman Municipal Code (BMC). BACKGROUND: The Final Site Plan to allow the construction of 12 condominium units, and related site improvements, at 5349 Baxter Lane, located within the Baxter Square Subdivision PUD, was initially approved on June 14, 2007. As allowed by Code, the Planning Director had previously administratively approved a one year extension to the approval (which set the expiration date for June 14, 2009). At the request of the applicant, and as allowed by Code, the City Commission approved a six month extension to the approval in June of this year. As noted in the attached request from D & D Palmer, a request is now being made for an additional six month period. As part of our evaluation, staff reviewed the requested extension with the Development Review Committee (DRC) to determine that the circumstances or conditions had not changed since the initial approval that would not warrant granting the extension. The DRC was fully supportive of the requested extension. FISCAL EFFECTS: The Department of Planning and Community Development is not aware of any fiscal effects at this time.
