Laurel Glen presents unique problems because it was originally approved prior to the
UDO. At that time wetlands were counted as parkland for dedication requirement
purposes, and phases did not have to keep up with parkland requirements as long as
there was sufficient parkland in the entire development. The parkland included in
Phase 1 is insufficient, approved under the assumption that the shortfall would be made
up in subsequent phases.
Now their preliminary plat has expired and they are seeking a renewal. As a condition
of this renewal the Commission has required that the area of the park in Phase II that
lie west of Baxter Creek be completed now. Problems arise because the city has no
ownership of the land until the parkland is dedicated which does happen after
preliminary plat approval. Consequently the developer has felt free to proceed on his
own terms, without consulting city specs and the city has no leverage to prevent this.
The master plan requires that the park improvements be completed by summer 2009.
This will have to be extended to summer 2010
Recommendations:
Approve the Park Master Plan with the attached conditions

Alternatives:
In my opinion there is nothing to gain denying this plan which is adequate, if not
spectacular or requiring that a new plan be drawn that we can accept without
conditions. That would be the commission’s decision.
