COMMISSION RESOLUTION NO. 4197A
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH BN BUILDERS, INC., BOZEMAN, MONTANA.
WHEREAS, the City Commission did, on the 27th day of May 2009, authorize award of the bid for
the Construction of the Bozeman Landfill Addition to BN Builders, Inc., Bozeman, Montana; and
WHEREAS, Section 7 -5 -4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and /or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and /or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and /or alterations to the contract between the City of Bozeman, a
municipal corporation, and BN Builders, Inc., Bozeman, Montana, as contained in Change Order #1 and
Change Order #2, attached hereto, be and the same are hereby approved; and the City Manager is hereby
authorized and directed to execute the contract change order for and on behalf of the City; and the City Clerk
is authorized and directed to attest such signature.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular
session thereof held on the 31 st day of August, 2009.

As per our conversation 1 am providing pricing for the following. additional work:

After reviewing.the project plans and our proposal. In our proposal it clearly states the
item that were .included in the proposal for the additive .alternate. Additionally:if you look
at sheet 5=1, figurel, it clearly shows.that the concrete apron and stoop-are outside the
extent of additive alternate 01.
I also want to .bring to your attention that additional work will be required on the north
end of the new addition that is not shown on sheets A 2 -1 and A 2 -2. This work will
include additional asphalt removal, gravel added for grade changes and additional
pavement to be placed. We will price this additional work when it is the extent of work
of the additional work is determined.
In our proposal we priced the asphalt as a three-inch thick section, Since we are placing a
four -:inch thick section on this project, we are requesting additional compensation for the
increased asphalt quantity (approximately 50 ton). An alternative is to have the pavement
section reduced to a 3" section, which is a more common thickness for parking areas.
