BACKGROUND: Earlier this year the Commission directed staff to prepare the necessary documents to formally declare Lot 1A-2 of the Second Amended Plat of Block 3 of Butte Addition to the City of Bozeman public parkland, as a means of conferring status upon it similar to that enjoyed by dedicated parks. “Story Park,” as staff is suggesting the subject property be referred to, has not previously been dedicated to the public. Resolution 4227 would formally declare the lot parkland, putting future Commissions and members of the public on notice that it is the expressed will of the current Commission that Story Park be maintained and managed as a public park in perpetuity. Report compiled: December 9, 2009 Attachments: Resolution No. 4227 Second Amended Plat of Block 3 of Butte Addition to the City of Bozeman 104 COMMISSION RESOLUTION NO. 4227 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, REGARDING A TRACT OF LAND COMMONLY KNOWN AS STORY PARK, BEING LOT 1A-2 AS DEPICTED ON THE SECOND AMENDED PLAT OF BLOCK 3 OF BUTTE ADDITION TO THE CITY OF BOZEMAN, CONSISTING OF 1.1092 ACRES, DECLARING SAID TRACT OF LAND TO BE PUBLIC PARK LAND. WHEREAS, The subject property is owned by the City of Bozeman; and WHEREAS, It is the intent of the City of Bozeman to developed and maintain the subject property as public parkland; and WHEREAS, It is the intent of the City of Bozeman to allow utilization of the subject property by the public for park purposes; and WHEREAS, The subject property has not been formally dedicated as public parkland through a subdivision and platting process; and WHEREAS, The Commission finds that formally declaring Story Park public parkland would be in the community’s best interest, to help ensure that the property continues to be owned by the public and managed as public parkland; and WHEREAS, Formally declaring Story Park public parkland would advance the goals and objectives of the adopted Parks, Open Space and Trails (PROST) Plan, which states the City’s parks, recreation programs, and facilities, open spaces and trails play a vital role in defining Bozeman as “the most livable place;” 105 NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1 That Story Park, as described above and as shown on the Second Amended Plat of Block 3 of Butte Addition to the City of Bozeman is hereby declared to be public parkland to be utilized by the citizens of the City of Bozeman, Montana pursuant to and consistent with various ordinances of the City of Bozeman. Section 2 That City of Bozeman staff shall take such steps as necessary to ensure a public record of this action is recorded with the Clerk and Recorder’s office of Gallatin County, Montana, so that this Declaration of Parkland is known to all men and women as the will of the City Commission of the City of Bozeman, Montana.
