PROJECTUPDATE: In2005theCityCommissionapprovedsubmittalofanapplicationfor CTEPfundstoconstruct2.08milesofa10footwidepathwaytobeginat11thandCollegeand continuetoHuffineandFerguson. AttheJune16,2009Commissionmeeting,theCommissionauthorizedtheCityManagerto signacontractwithRobertPecciaandAssociates(RPA),inHelena,fortheengineering,design andmanagementoftheCTEPfundedCollege-HuffinePathwayproject. TheCityofBozemaniscurrentlyundercontractwithRPA.Certainareasalongthepathway corridorwereidentifiedduringtheoriginalcontractnegotiationaspossiblyrequiringadditional easementsinordertoconstructthepathwayinthesafestandmostdesirablelocation.Thiswas alsonotedintheoriginal2005CTEPapplication.Becausetherewerenoengineeringanddesign plansatthattime,thosespecificneedswereunknown.Thoseeasementshavenowbeen identified. Thepathwaydesignhaschangedsomewhatfromtheoriginallinearpathwaytoapathwaywith averyslightmeander.Thereasonforthischangeistopromoteandencouragepedestrian travelbymakingthetravelexperiencemoreinterestingandaesthetic.Moreso,thealignmentof thepathwayhasshiftedtothesouth,alongCollege,toavoidconstructingtooclosetotheroad andunderpowerlines,whichiswhytheeasementsareneeded.Thepathwaymaterialhasbeen changedfromconcretetoasphaltforseveralreasons;asphaltislessexpensiveandeasierto repair,thedarksurfacemeltssnowandicemorequicklythanconcrete,andthesurfaceiseasier onjointsforrunnersandwalkers.  Constructioncostdifferencesbetweenthe2008AlternativeAnalysisandthe2009Construction estimateresultfromadditionalitemsbeingincludedinthefinalprojectestimatesuchas; signage,ADArampsandimprovements,andthermoplasticstriping.Theseadditional improvementsadduptoabout$85,500inthe2009estimate.Inadditiontotheseimprovements, anyeasementsdonatedbyMSUwouldrequireafencereplacement,whichisestimatedat $22,500. Inadditiontotheeasementneeds,staffhasindentifiedtheneedforaspurpathwayrunning northfromHuffine,alongtheeastsideofFowler,toconnectwiththeBozemanPondand includedthatintheprojectscope,whichinvolvesadditionalengineering. CONTRACTAMMENDMENT: ThecostofthecurrentengineeringcontractwithRPA signedin2009is$83,175.Thiscontractprovidesforthenecessaryengineeringanddesign work,andprojectoversightandmanagement.Staffisrecommendinganadditional$25,494in CTEPfundingbeapprovedasanamendmenttothecontracttocompleteeasementnegotiations, landappraisals,acquisition,andadditionalengineeringanddesignworkfortheconnector pathwaytotheBozemanPonds. Nowthattheengineeringplansarenearlycomplete,andsomepreliminarynegotiationmeetings havebeenheldwithadjacentlandowners,RPAhasafirmcostforthecompletionofthose negotiations,theprocurementoftheeasementdonations,andtheadditionalengineeringforthe spurtrailtotheBozemanPond.Thisassumes,asindicatedbythepreliminarydiscussionswith landowners,thatalleasementswillbedonatedtotheCity,however,thecostofanyeasements notdonatedtothecitywillbeaddedtotheprojectcostsandmostlikelywillresultinthe pathwaybeingbuiltintheoriginalexistingpedestrianway.Ifanyoftheeasementsneededfor thecurrentmeanderingpathwaydesignarenotdonatedtotheCity,thoseareaswillrevertback tothepubliceasement,whichisclosertotheroad,inordertoavoidpropertyencroachment. AnycontractamendmentsforCTEPprojectsmustbeauthorizedbyCTEPinHelena.As indicatedintheattachment,MDThasgivenwrittenauthorizationforthisamendment. FISCALEFFECTS: In2009,Bozeman'sannualallocationforCTEPfundingwas approximately$160,000. TheCTEPprogramfunds86.58%ofthecostsofanapprovedproject. Alocalmatchfortheremaining13.42%mustbeprovided. OuroriginalCTEPapplicationestimatedtheCollege-HuffinePathwayprojectatatotalcostof $447,029.Right-of-Way(easements)acquisitioncostswerelistedas“Unknown.”Basedon 2005costsandourRPAcontract,CTEPhasearmarked$398,443astheirshare,requiringa $61,759localmatch.Priortothisproposedcontractamendment,Bozeman’sunencumbered CTEPbalanceis$293,565.Thisamendedproject(withupdatedconstructioncostestimates)is estimatedtorequireanadditional$131,659inCTEPallocation,leaving$161,905inour remainingCTEPfunds. Thisamendedprojectwillalsoincreaserequiredlocalmatchmoneyby $20,407. EachyeartheGeneralFundbudgets$30,500forCTEPmatchingfunds.Ifthemoneyisnot neededformatch,itremainsintheGeneralFund.Knowingthatcashmaybeneededforthis project,wearecarrying-overtheFY09budgetamount,andwillcombineitwiththeFY10 amountforatotalof$61,000cashavailableinlocalmatchingdollars.Totalprojectcostsand easementvalueswillbeavailablethisspring.Iflocalmatchingdollarsarerequiredbeyondthe $61,000available,weanticipatebringingforwardanFY11budgetrequesttofullyfundthe localmatch.
