ITEM 1. CALL TO ORDER AND ATTENDANCE
Vice President JP Pomnichowski called the meeting to order at 7:00 p.m. and directed the secretary to record the attendance.

Vice President Pomnichowski OPENED THE MEETING FOR PUBLIC COMMENT on any public matter within the jurisdiction of the Planning Board and not scheduled on this agenda. Hearing none,
she CLOSED THE PUBLIC COMMENT portion of the meeting.
Mr. Brey suggested Items 3 and 4 be reviewed prior to his presentation. Following a brief discussion among the Board and Staff, Vice President Pomnichowski stated Mr. Brey’s presentation
would be continued to after the project reviews.
ITEM 4. CONSENT ITEM
Minor Subdivision Preliminary Plat Amendment Application #P-05040 - (First Security Bank). A Minor Subdivision Preliminary Plat Amendment Application, requested by the property owner,
First Security Bank, represented by Think One, to
amend Minor Subdivision #340 to allow access onto Cottonwood Road over an existing “one foot no access strip.” The property is legally described as Lot 5, Minor Subdivision #340, located
in the SW ¼ of Section 10, T2S, R5E, PMM, City of Bozeman, Gallatin County, Montana. The property is generally located at 642 Cottonwood Road. (Morris)
Vice President Pomnichowski asked Staff and the applicant if they had any information to share. Staff stated the information was contained in the Staff report. Rusty Harris, applicant’s
representative, stated he and the applicant have come to terms with the Engineering Staff on the location of the access, including a full access onto Cottonwood Road.
MOTION: Mr. Musser moved, Mr. Krauss seconded, to approve application #P-05040 with any staff conditions. The motion carried unanimously.
ITEM 5. PROJECT REVIEW
Minor Subdivision Preliminary Plat Application #P-04062 - (Brady Avenue). A Minor Subdivision Preliminary Plat application, requested by the applicant, Stockyard, LLC, represented
by ThinkTank Design Group, Inc., to allow the subdivision of ~ 2 acres into 4 residential lots. The property is owned by Tom & Susan Vander Vos, and is described as Lot 20, Block 7,
Babcock & Davis Addition, City of Bozeman, Gallatin County, Montana. The property is generally located at north end of Brady Avenue, between Wallace Avenue and Ida Avenue. (Kozub)
B. Major Subdivision Preliminary Plat Application #P-04061 - (The Legends at Bridger Creek). A Major Subdivision Preliminary Plat application, requested by the applicants, Brownstone
Capital, represented by Van Bryan Studio Architects, to allow the subdivision of 20.12 acres into 65 residential lots. The property is owned by Aspen Properties I, LLC, is described
as a tract of land being Tract 7A of Certificate of Survey No. 2408, and is situated in the NW¼ SW¼ of Section 32, T1S, R6E, PMM, City of Bozeman, Gallatin County, Montana. The property
is generally located at the northeast corner of the intersection of Story Mill Road and Boylan Road extended. (Morris)
MEET JOINTLY WITH ZONING COMMISSION
C. Major Subdivision Pre- Application #P-04058 - (Creekwood). A Major Subdivision Pre-Application, requested by the owners/applicants, Snowload LLC, represented by Gaston Engineering
& Surveying, to allow the subdivision of ~ 38 acres into 53 residential lots. The property is described as a tract of land being the second tract described in Document No. 2012272,
situated in the E½, SE¼ of Section 32, T1S, R6E, PMM, City of Bozeman, Gallatin County, Montana. The property is generally located north of Bridger Drive, northeast of Headlands Subdivision.

A. INFORMAL REVIEW
Informal Application #I-04031 - (Churn Creek Meadows). An Informal Application, requested by the owners OBD Inc., represented by Springer Group Architects , P.C., to annex and provide
urban zoning of R-1 (Residential, Single Family, Low Density District) for 360 acres. The property is currently zoned A-S (Agriculture Suburban) in the county. The property is located
East of Story Mill Road, just east of the City of Bozeman Landfill. (Morris

ITEM 56. OLD BUSINESS Major Subdivision Preliminary Plat Application #P-05048 - (Westwinds II). A Major Subdivision Preliminary Plat Application, requested by HKM Engineering, representing
the owners, Cascade Development Inc., to allow the subdivision of 129 acres into 113 residential lots and a 95 acre residential remainder. The property is legally described as West
Winds Major Subdivision Phase 2A & 2B, and is situated in the NW ¼ of Section 2, T2S, R5E, PMM, City of Bozeman, Gallatin County, Montana The property is generally located at the southwest
quadrant of the intersection of Baxter Lane and future North 27th Avenue. (Morris)
Associate Planner Jami Morris presented the Staff Report.
Mr. Jarrett asked about the condition that requires the GPS of a ditch. Planner Morris noted the engineering company hired Garcia & Associates to do a cultural resource inventorydid
the GPS’ing for historical background and it was their reccommendation to do the GPS’ing for the historical record of the ditch which is being abandoned.
Clint Litle, HKMHJM Engineering and applicant’s representative, noted he was there to answer questions.
Ms. Stroup asked where the elderly assisted living facilities would be located. Mr. Litle noted they would be located near the corner of Oak Street and Fowler Lane.
Vice President Pomnichowski asked if most of these lots are RSL lots. Mr. Litle noted the RSL lots are labeled and that in addition the large affordable housing lot would also be reserved
to meet the RSL requirement. . Other lots are duplex lots.

FOR PUBLIC COMMENT, and hearing none, she CLOSED THE PUBLIC COMMENT PORTION OF THE MEETING.
Mr. Hope asked if the .03 acres/unit for the park space was that based on the original PUD numbers. Planner Morris noted they had three choices and choose to meetcontinue the condition
of approval. They could provide additional parkland or cash in lieu for the extra lot, remove the extra lot from the current phase or remove the extra lot from phase three..03 acres
per residential unit.
MOTION: Mr. Jarrett moved, Mr. Hope seconded, to approve application #P-05048 with Staff conditions. The motion carried unanimously.
ITEM 3. JOINT MEETING WITH ZONING COMMISSION
TIF/Urban Renewal Discussion – Ron Brey
The Zoning Commission was called to order at 7:15 p.m. A joint meeting followed.
Ron Brey, Assistant City Manager, presented information on Urban Renewal. He noted it provides a community with a source of revenue for development. Mr. Krauss explained taxable value
and its history in the Downtown area. Mr. Brey read from statute the responsibility of the Planning Board, which is to determine if the pUrban Renewal Plan conforms with the Bozeman
Area 2020 Community Plan.
ITEM 6. OLD BUSINESS
Vice President Pomnichowski asked why the Board isn’t doing the final UDO edits.
Director Epple noted the last ones will be on the next agenda. Mr. Jarrett noted he is frustrated with the time the UDO edits have taken.
Director Epple noted Mr. Brey’s presence was due to the Board’s request. He noted City Engineering Staff have agreed to present information on the water/sewer infrastructure, but after
the new facilities plan has been developed. Some members of the Board responded they would like information now on the situation and also following the development of the new facilities
plan. Director Epple noted Staff would inquire about the request.

There being no further business to come before the Planning Board and Zoning Commission, the joint meeting was adjourned at 9:10 p.m.
