AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING A PORTION OF SECTION 2 OF
ORDINANCE 1081, CODIFIED THEREIN AS 10.19.016 AND
CURRENTLY CODIFED AS SECTION 13.36.090 OF THE BOZEMAN
MUNICIPAL CODE CHANGING THE PROVISION FOR TWO YEAR
REVIEW OF THE PERCENTAGE OF EACH USER'S WASTEWATER
CONTRIBUTION TO THE CITY'S SEWER SYSTEM AND REQUIRING
INSTEAD ANNUAL REVIEW THEREOF.
Preamble.
The purpose of this ordinance is to amend the City of
Bozeman's sewer ordinance to comply with requirements of
the United States Environmental Protection Agency and to
provide for public health, safety and welfare by
assuring that sufficient funds are obtained to
adequately operate and maintain the wastewater treatment
works by requiring annual review of each user's
wastewater contribution percentage.
NOW, THERFORE, BE IT ORDAINED by the City Commission of the
City of Bozeman, Montana, that a portion of Section 2 of Ordinance
1081 as codified therein as Section 10.19.016 and as
currently codified as Section 13.36.090 of the Bozeman
Municipal Code be amended with deletions struck through and
additions underlined as follows:
13.36.090 Review of wastewater service charges.
The City shall review annually the total annual cost of
operation and maintenance, as well as each user's Wastewater
Contribution Percentage Ae~ ~ess e~~eA ~RaA eve~y ~we yea~s, and
will revise the system as necessary to assure equity of the
service charge system established herein and to assure that
sufficient funds are obtained to adequately operate and maintain
the wastewater treatment works. If a significant user, such as an
industry, has completed in-plant modifications which would change
that user's Wastewater Contribution Percentage, the user can
present, at a regularly scheduled meeting of the governing body,
such factual information, and the City shall then determine if the
user's Wastewater Contribution Percentage is to be changed. The
City shall notify the user of its findings as soon as possible.
