ORDINANCE NO. 1382
AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE BOZEMAN ZONE MAP'S
ZONING DISTRICT DESIGNATIONS FROM AN "A-S" (AGRICULTURAL--
SUBURBAN) DISTRICT TO "R-S" (RESIDENTIAL--SUBURBAN),
ON TRACT
1, CERTIFICATE OF SURVEY NO. 748A, TRACTS 1-5, CERTIFICATE
OF
SURVEY NO. 748C, AND TRACTS 3A AND 3A1 (REMAINDERS)
OF
CERTIFICATE
OF SURVEY NO.
748B, ALL SITUATED IN
THE
SOUTHEAST ONE-QUARTER OF SECTION 16, TOWNSHIP 2 SOUTH,
RANGE 6 EAST, MONTANA PRINCIPAL MERIDIAN, IN THE CITY
OF
BOZEMAN, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment has been properly
submitted,
reviewed and advertised in accordance with the procedures of the Bozeman Municipal Code;
and
WHEREAS, the City-County Planning Board held a public
hearing on November 2,
1993, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City-County Planning Board recommended
to the Bozeman City
Commission that the requested zone map amendment be approved; and
WHEREAS, the City Commission held a public hearing on
November 15, 1993, to
receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Commission has reviewed and considered
the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
amendment to be in compliance with the twelve criteria; and
WHEREAS, the City Commission has found that the proposed
zone map amendment
would be in compliance with the Bozeman Area Master Plan and will be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission
of the City of
Bozeman, Montana:
Section 1
That the zoning district designation of the following-described
property is hereby
amended from an "A-S" (Agricultural--Suburban) District to "R-S" (Residential--Suburban)
District:
Tracts of land located in Section 16, Township 2 South,
Range 6 East,
Montana Principal Meridian, Gallatin County, Montana,
and being further
described as follows:

Parcel 1: Tracts 1, 2, 3, 4 and 5 of Certificate of
Survey No. 748C. a
tract of land being Tracts 1 and 4A of Certificate of
Survey No. 748A,
and Tracts 3A and 3A-1 of Certificate of Survey No.
748B, all situated in
the Southeast one-quarter of Section 16, Township 2
South, Range 6
East, Montana Principal Meridian, Gallatin County, Montana,
according to
the official plat thereof on file and of record in the
office of the County
Clerk and Recorder of Gallatin County, Montana.
Parcel 2: A tract of land in the Southeast one-quarter
of the Southeast
one-quarter of Section 16, Township 2 South, Range 6
East of the
Montana
Principal Meridian, Gallatin
County, Montana, and more
particularly described by the following metes and bounds,
to-wit:
Beginning at the Southeast corner of said Section 16;
thence bearing
West along the South boundary of said Section 16 a distance
of 1,078.8
feet; thence N3025'W; a distance of 404.5 feet; thence
East 1,078.8
feet; thence S3 0 25'E along the East boundary of said
Section 16 a
distance of 404.5 feet to the point of beginning.
According to plat
recorded in Book 151 of Deeds, page 74.
EXCEPTING THEREFROM all of that portion of the above
described
property contained within Correction Survey Certificate
of Survey No. 356
as following:
A tract of land in the Southeast one-quarter of Section
16, Township 2
South, Range 6 East, Montana Principal Meridian, Gallatin
County,
Montana, and described as follows:
Beginning at a point which bears N89053'37"W from the
Southeast
corner of said Section 16, a distance of 431.52 feet,
thence continuing
N89053'37"W, a distance of 215.76 feet, thence N03016'20.'W.
a
distance of404.50 feet, thence S89053'37"E, a distance
of 215.76 feet,
thence S030 16'40"E, a distance of 404.50 feet to the
point of beginning.
Said parcel containing approximately 145 acres.
Section
2
The effective date of this ordinance is August 1, 1994.
PASSED by the City Commission of the City of Bozeman,
Montana, on first reading,
at a regular session thereof held on the 13th day of June 1994.
