ORDINANCE NO. 1383
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN MUNICIPAL CODE BY AMENDING
SECTION 10.32.390, PERTAINING TO THE PROHIBITION OF IMPROPER USE
OF RESIDENTIAL PARKING PERMITS AND ADDING SECTION 10.32.410.B.4
ESTABLISHING THE PENAL TY FOR IMPROPER USE OF RESIDENTIAL
PARKING PERMITS.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA:
SECTION 1
That section 10.32.390 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
"10.32.390 LAWFUL DISPLAY OF RESIDENTIAL PARKING PERMITS REQUIRED.
A. Residential parking permits and temporary visitor's
permits shall be displayed
on a vehicle in the place and in the manner prescribed by the City. It is unlawful to either
fail to display or improperly display a residential parking permit, or to attempt to use a
residential parking permit from another area in a designated residential area.
.e... It shall be unlawful for the holder of a residential
oarking oermit to fail to
surrender it when directed to do so.
k It shall be unlawful for any oerson to reoresent in
any fashion that a vehicle is
entitled to a residential oarkina oermit authorized bv Section 10.32.370 or other aoolicable
orovisions when it is not so entitled. The disolav of a residential oarkinq oermit on a vehicle
not entitled to such a oermit shall constitute such a reoresentation.
D. It shall be unlawful for any oerson to duolicate. bv
any means. a oarkina oermit
authorized bv Section 1 0.32.370 or other aoolicable provisions. It shall also be unlawful for
any oerson to disolav on any vehicle such a duolicate oarking oermit."
SECTION 2
That section 10.32.410 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
1 0.32.41 0 Enforcement - Penalty for Violations
A. It is a misdemeanor for any person to violate any of the provisions of this chapter.
B. Every person convicted of a misdemeanor for a violation of any of the provisions

of this chapter shall be punished by a fine of not less than five dollars or more than three
hundred dollars with the following exceptions:
1.
The minimum fine for overtime parking in violation of the
following provisions shall be two dollars:
a. Sections 10.32.240 through 10.32.260, inclusive.
2.
The minimum fine for violation of the following provisions shall
be ten dollars:
a. Section 10.32.350 through 10.32.390181. inclusive.
3.
The minimum fine for violation of the following provisions shall
be fifteen dollars:
a. Section 10.32.030(A) (1) through (6), inclusive;
b. Section 10.32.030(A) (10);
c. Section 10.32.180;
d. Section 10.32.190.
4.
Violation of Sections 10.32.390 (B) through (DL inclusive. shall
be Dunishable bv a fine not exceedina five hundred dollars or imorisonment not
exceedina six months or both.
C. Upon conviction, the court costs or any part thereof may be assessed against the
violator in the discretion of the court."
SECTION 3
REPEALER.
All resolutions, ordinances, and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
SECTION 4
SEVERABILITY.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this
ordinance which may be given effect without the invalid provision or application and, to this
end, the provisions of this ordinance are declared to be severable.

SECTION 5
EFFECTIVE DATE.
This ordinance shall be effective thirty (30) days after
final adoption as provided by
law.
