ORDINANCE NO. 1346
AN ORDINANCE OF THE CITY COMMISSION
OF THE CITY OF
BOZEMAN,
MONTANA, AMENDING THE
ZONING DISTRICT
DESIGNATION
FROM AN "R-3"
(RESIDENTIAL --MEDIUM-DENSITY)
DISTRICT TO AN "R-O" (RESIDENTIAL--OFFICE) DISTRICT
ON PROPERTY
IDENTIFIED AS BEING LOTS 2, 3, 4 AND 5, BLOCK 1, KIRK'S
SUBDIVISION NO.1 LOCATED IN THE CITY OF BOZEMAN, AND
MORE
COMMONLY KNOWN AS 105, 109, 113 AND 117 SOUTH 19TH
AVENUE.
WHEREAS, the proposed zone map change has been properly
submitted, reviewed
and advertised in accordance with the procedures of the provisionally adopted Bozeman zone
code, dated August 19, 1991; and
WHEREAS, the City-County Planning Board held a public
hearing on April 7, 1992,
to receive and review all written and oral testimony on the request for a zone map change;
and
WHEREAS, the City Commission held a public hearing on
April 20, 1992, to receive
and review all written and oral testimony on the request for a zone map change; and
WHEREAS, the City Commission has reviewed and considered
the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
change to be in compliance with the twelve criteria; and
WHEREAS, the City Commission has found that the proposed
zone map change
would be in compliance with the Bozeman Area Master Plan and would be in the public
interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission
of the City of
Bozeman, Montana:
That the zoning district designation of the following-described
property shall be and
is hereby changed from an "R-3" (Residential--Medium-Density) District to an "R-O"
(Residential--Office) District:
Lots 2, 3, 4 and 5, Block 1, Kirk's Subdivision No.1,
located in the City
of Bozeman, and more commonly known as 105, 109, 113
and 117
South 19th Avenue.
