AN ORDINANCE
OF THE CITY COMMISSION
OF THE CITY OF
BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL
CODE, BE AMENDED BY ADDING A NEW SECTION TO BE NUMBERED
15.30.010; PROVIDING FOR THE ADOPTION OF THE UNIFORM CODE
FOR BUilDING CONSERVATION 1991 EDITION, DELETING CHAPTERS
4, 5, AND 7 THEREFROM EXCEPT AS REFERENCED BY CHAPTER 6;
AND REPEALING ORDINANCE NO. 1325.
Preamble
The purpose of this code is to encourage the continued use or
reuse of legally existing buildings and structures. The provisions of this
code shall constitute the minimum standards for change of occupancy,
alteration or repairs of existing buildings and structures within this
jurisdiction.
BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA:
Section 1
That the Bozeman Municipal Code be amended by adding a section to be numbered
section 15.30.010, to read as follows:
"15.30.010 Adoption by reference of the Uniform Code for Buildin9 Conservation, 1991
Edition.
That a certain document. one ( 1) coov of which is on file and is aDen for insoection
bv the oublic in the office of the City Clerk of the City of Bozeman. 411 East Main Street,
Bozeman. Montana. and one (1) cODy of which is on file at the Office of the Building Official.
beinQ marked and desiQnated as: Uniform Code for BuildinQ Conservation. 1991 Edition.
oublished bv the International Conference of Building Officials. excluding Chaoters 4. 5. and
7 exceot as referenced bv Chaoter 6 - Historic Structures. be and the same are hereby
adooted as the code of the iurisdiction of the City of Bozeman for reQulating the minimum
standards for change of occuoancv. alteration or reoair of existing buildings and structures
in the jurisdiction of the City of Bozeman providing for issuance of oermits and collection of
fees therefor; and each and all of the regulations. orovisions. conditions and terms of such
Uniform Code for Building Conservation. 1991
Edition. oublished bv the International
Conference of BuildinQ Officials, all of which are on file in the office of the Clerk of the City
Commission and are hereby referred to. adooted and made a Dart hereof as if fullv set out
in this ordinance."

Section 2
Reoealer.
That Ordinance No. 1325 of the City of Bozeman entitled
AN ORDINANCE OF THE
CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, ADOPTING
BY REFERENCE
THE SECOND PRINTING OF THE UNIFORM CODE FOR BUILDING
CONSERVATION,
COPYRIGHTED 1987, WITH CHAPTERS 4, 5, AND 7 DELETED
THEREFROM EXCEPT AS
REFERENCED BY CHAPTER 6 - HISTORIC STRUCTURES, REGULATING
THE MINIMUM
STANDARDS FOR CHANGE OF OCCUPANCY, ALTERATION OR REPAIR
OF EXISTING
BUILDINGS AND STRUCTURES AND ESTABLISHING A PENALTY
FOR VIOLA TION
THEREOF; and all other resolutions, ordinances, and
sections of the Bozeman Municipal
Code, or parts thereof, in conflict herewith are hereby
repealed.
Section 3
Savings Provision.
This ordinance does not affect the rights and duties
that matured, penalties that were
incurred or proceedings that were begun before the effective
date of this ordinance.
Section 4
Severabilitv.
If any portion of this ordinance is declared unconstitutional
or the applicability thereof
to any person or circumstances is held invalid, such
invalidity shall not affect other
provisions or applications of this ordinance which may
be given effect without the invalid
provision or application and, to this end, the provisions
of this ordinance are declared to be
severable.
Section 5
Effective Date.
This ordinance shall be effective thirty (30) days after
second reading and final
adoption as provided by law.
