HomeMy WebLinkAboutOrdinance 92- 1350, Adds § 15.12.030 and amends 8 15.12.030, mechanical code -- .. -I ~ ORDINANCE NO. 1350 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE, AS AMENDED BY ORDINANCE NO. 1288 AND NOT CURRENTLY CODIFIED IN THE BOZEMAN MUNICIPAL CODE, BE AMENDED BY REVISING SECTION 15.12.010 OF SAID CODE, AND ADDING A SECTION TO BE NUMBERED SECTION 15.12.030; PROVIDING FOR ADOPTING THE 1991 EDITION OF THE UNIFORM MECHANICAL CODE; AND PROVIDING FOR ADDITIONS AS SPECIFIED HEREIN. BE IT ORDAINED BY THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA: Section 1. That Section 15.12.010 of the Bozeman Municipal Code be amended so that such section shall read as follows: "15.12.010 Document Adopted by Reference--Copies on File. A certain document, thrcc (2) copics one ( 1) coov of which ere is on file in the Office of the Building Official of the City of Bozeman, Montana, and at the offices of the City Clerk of the City of Bozeman, 411 East Main Street, Bozeman, Montana, being marked and designated as the Uniform Mechanical Code, 4-988 1991 Edition, published by the International Conference of Building Officials, including Aooendix B Chaoters 22 and 23. be and the same is hereby adopted as the Mechanical Code of the City of Bozeman for regulating and controlling the design, construction, installation, quality of materials, location, operation and maintenance of heating, ventilating, cooling, refrigeration systems, incinerators and other miscellaneous heat-producing appliances in the City of Bozeman and its iurisdictional area; providing for issuance of permits and collection of fees therefore; providing penalties for violation of such code; and each and all of the regulations, provisions, penalties, conditions and terms of such "Uniform Mechanical Code," -1-988- 1991 Edition, published by the International Conference of Building Officials, on file in the eOffice of the Building Official, are hereby referred to, adopted and made a part hereof as if fully set out in this ordinance; save and except such portions thereof as have been deleted, modified, or amended as hereinafter set forth." Section 2. That the Bozeman Municipal Code be amended by adding a section to be numbered section 15.12.030, to read as follows: .. ~ - "15.12.030 Amendments and additions to Uniform Mechanical Code. The following is hereby added to the most current adopted Uniform Mechanical Code section 504 (f): (d) LPG Appliances may be installed in single family dwellings not withstanding the prohibition on the installation of such appliances by the UMC and the UPC provided: ill All LPG piping is pressure tested to insure it is aas tiaht and not installed in concealed locations. Concealed LPG piping means piping and fittinas which. when in place in the finished buildings. would reauire removal of permanent construction to oain access to the pioing. Pioing may be installed in an attic, under floor area. includina basement or crawl soace. provided this area is adeauately ventilated from at least two exposed sides of the building. Each ventilation ooenina shall be a minimum of 36 sauare inches. .illl The appliance is ventedwtyoe. aooroved by a nationally recognized testina organization. and installed in accordance with the manufacturer's recommendations. lliU Automatically controlled LPG appliances shall be of the comolete shut off type. Comolete ( 100%) shut off means the gas to both the pilot light and the main aas burner(s) will shut off in the event of pilot outage. iiYl A readily accessible and identified shut off valve controlling the flow of gas to the entire gas oioing svstem shall be installed near the point of connection to the service oioing or supply connection of the LPG tank. The container service valve may be used for this puroose. M The installer shall oromPtly report any accident/incident where LPG may have been a factor. or could become a contributing factor. to the building codes bureau bv phone. If death or serious personal iniury occurs ar if oropertv damaae in excess of $500.00 results from anv such accident/incident. a written report shall be prepared bv the installer and oresented to the bureau within 15 davs of the accident/incident. 1Yll A LPG detection/shut-off valve svstem shall be installed that sounds an alarm and shuts off the main gas suooly in the event of the detection of LPG. The valve shall be solenoid type shut-off valve. held ooen when Dowered, and shall be located outside the building foundation." Section 3. Repealer. All resolutions, ordinances, and sections of the Bozeman Municipal Code, or parts thereof, in conflict herewith are hereby repealed. Section 4. Savinas Provision. This ordinance does not affect rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 5. Severability. If any portion of this ordinance is declared unconstitutional or the applicability thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions or applications of this ordinance which may be given effect without the invalid provision or application and, to this end, the proYisions of this ordinance are declared to be severable. - 2 - ____________.__. _______u..._.___._ . -j Section 6 Effective Date. This ordinance shall be effective thirty (30) days after second reading and final adoption as provided by law.
