A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT
WITH EDSTROM CONSTRUCTION, INC., REXBURG, IDAHO.
WHEREAS, the City Commission did, on the 7th day of July 2009, authorize award of the bid for
the Lyman Creek Water System Infrastructure Improvements project, to Edstrom Construction, Inc., Rexburg,
Idaho; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications and/or plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,
Montana, that the proposed modifications and/or alterations to the contract between the City of Bozeman, a
municipal corporation, and Edstrom Construction, Inc., as contained in Change Order No. 1, attached hereto,
be and the same are hereby approved; and the City Manager is hereby authorized and directed to execute the
contract change order for and on behalf of the City; and the City Clerk is authorized and directed to attest such
signature.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular
session thereof held on the 28th day of September 2009.

Change Order No. 1 -Section 01150 Modifications
Add the following paragraphs to Paragraph 1.05 A. to Section 01150:
Bid Item 101 shall be paid at a maximum of 3% of Schedule I with the first pay
request. Subsequent pay requests may include the remaining value of this bid
item based on a proportional ratio to the total amount of Schedule I.
2. Bid Item 102 shall be paid at actual costs associated with Schedule I, based on
documentation provided by the Contractor, with the first pay request up to a
maximum amount of the bid item. If the bid item has remaining value after the
first pay request, the remaining portion of the total value of the bid item will be
paid at a proportiona! ratio to the total amount of Schedule I.

Change Order No. 1
MEETING DATE: September 28, 2009
AGENDA ITEM TYPE: Consent
RECOMMENDATION: Authorize City Manager to sign change order number 1.
BACKGROUND: Attached is a copy of change order number one for the above referenced project.
This is a no cost, no time change order that is being processed to clean up the minor bid irregularities that
the contractor had on their bid. The bid irregularities were considered and waived as part of the notice of
award that was previously approved by the commission. This change order will simply formalize that
previous action.
FISCAL EFFECTS: None
ALTERNATIVES: As suggested by the City Commission.
