ORDINANCE NO. 1355 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE ZONING DISTRICT DESIGNATION FROM AN "A-S" (AGRICULTURE SUBURBAN) TO AN "R- 2" (RESIDENTIAL, SINGLE-FAMll Y, MEDIUM DENSITY) ON 12.441 ACRES; FROM AN "A-S" (AGRICULTURE SUBURBAN) TO AN "R-3" (RESIDENTIAL, TWO-FAMILY, MEDIUM-DENSITY) ON 12.103 ACRES; FROM AN "A-S" (AGRICUL TURE SUBURBAN) TO A " B-1 .. (NEIGHBORHOOD SERVICE) ON 13.798 ACRES; AND FROM AN "A-S" (AGRICULTURE SUBURBAN) TO AN "R-O" (RESIDENTIAl--OFFICE) ON 27.101 ACRES, ALL LOCATED IN THE NORTHEAST % AND THE SOUTHEAST % OF SECTION 26 AND THE SOUTHWEST % OF SECTION 25, TOWNSHIP 1 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN, GALLATIN COUNTY MONTANA, AND MORE COMMONLY KNOWN AS THE WALKER PROPERTY SUBDIVISION. WHEREAS, the proposed zone map change has been properly submitted, reviewed and advertised in accordance with the procedures of the provisionally adopted Bozeman zoning ordinance, dated August 19, 1991; and WHEREAS, the City-County Planning Board held a public hearing on March 5, 1991, to receive and review all written and oral testimony on the request for a zone map change; and WHEREAS, the City Commission held a public hearing on March 18, 1991, to receive and review all written and oral testimony on the request for a zone map change; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map change to be in compliance with the twelve criteria; and WHEREAS, the City Commission has found that the proposed zone map change would bring the zoning of the property into compliance with the Bozeman Area Master Plan and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: That the zoning district designation of the following-described 12.441 acre property is hereby changed from an "A-S" (Agriculture Suburban) to an "R-2" (Residential, Single- Family, Medium-Density): A tract of land being a portion of the Walker Property Subdivision situated in the NE% and SE% of Section 2Gb and the SW% of Section 25, T1S, R5E, M.P.M., Gallatin County, Montana, and being further described as follows: .~~:~,',~~~:\~'.:,'",,",'" . .
