Babcock Street MEETING DATE: Monday, October 12, 2009 AGENDA ITEM TYPE: Consent. RECOMMENDATION: Approve the first reading of Ordinance 1774 adopting zoning of R-3 Residential Medium Density District on the parcels at 2502 W. Babcock Street, known as the Wenzel-Smiley ZMA. BACKGROUND: The City received an application for annexation and initial zoning on May 27, 2009. The property is located at 2502 West Babcock Street and is wholly surrounded by the City. The parcel is about .42 acres in size and has a single home on it. The City Commission acted favorably on the request for initial zoning at their public hearing on July 20th. The signed annexation agreement and materials have been provided as required by the Commission’s action. The ZMA now needs the implementing ordinance to be finalized. Attachments: Ordinance 1774 Report compiled on: October 6, 2009 95 1 ORDINANCE NO. 1774 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE CITY OF BOZEMAN ZONE MAP TO INCLUDE THE AREA OF CERTIFICATE OF SURVEY 63 & THE PLAT SHOWN ON FILE 144 PAGE 538 BOOK OF DEEDS AS “R-3” (RESIDENTIAL MEDIUM DENSITY) FOR 0.425 ACRES SITUATED IN SECTION 11, T2S, R5E, PMM, CITY OF BOZEMAN, GALLATIN COUNTY. WHEREAS, the proposed zone map amendment to grant a zoning designation of "R-3" (Residential Medium Density District) has been properly submitted, reviewed and advertised; and WHEREAS, the Bozeman Zoning Commission held a public hearing on July 7, 2009, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the Bozeman Zoning Commission recommended to the Bozeman City Commission that the zone map amendment be approved as proposed; and WHEREAS, after proper notice, the City Commission held its public hearing on July 20, 2008, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone map amendment criteria established in Section 76-2-304, M.C.A., and found that the proposed zone map amendment would be in compliance with the twelve criteria; and WHEREAS, at its meeting held on July 20, 2009, the City Commission found 96 2 that the proposed zone map amendment would be in compliance with Bozeman’s adopted growth policy and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby designated as "R-3" (Residential Medium Density District): Certificate Of Survey 63 & The Plat Shown On File 144 Page 538 Book Of Deeds Said parcel containing 0.425 acres more or less. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
