AN
ORDINANCE OF THE CITY COMMISSION OF THE
CITY OF
BOZEMAN, MONTANA, ACCEPTING THE DEDICATION TO PUBLIC
USE
OF FIELDSTONE DRIVE TO THE CITY OF BOZEMAN, MONTANA,
FOR A
PUBLIC STREET.
WHEREAS, the plat of Westfield Subdivision was filed
with Gallatin County Clerk
and Recorder on September 17, 1984; and,
WHEREAS, the Certificate of Dedication on this plat
grants to the public Wagon
Wheel Road and Graf Street. A note on the plat indicates
that Fieldstone Drive, as shown \.~>~.:-
by Exhibit "A" attached hereto, is a private road; and
another note that indicates Fieldstone
Drive is an access and utility easement for water, sewer
and other City services; and,
WHEREAS, the Declaration of Covenants, Conditions and
Restrictions for Westfield
Park, Phase One provides that the roadway shall be owned
by the Association for the
common use and enjoyment of the owners at the time of
the conveyance of the first lot;
and,
WHEREAS, Westfield Park Homeowners' Association, numerous
owners of lots
within Westfield Subdivision, and the developer, Clair
W. Daines and Sharon Daines, have
signed a Certificate of Dedication to dedicate to public
use Fieldstone Drive to the City of
Bozeman for a public street; and,
WHEREAS, MCA ~ 7-3-4446(2) provides that platted streets
dedicated to the public
be accepted and confirmed by ordinance passed for this
dedication prior to being deemed
a public street under the care or control of the Commission;
and,
WHEREAS, the Bozeman City Commission deems it in the
best interests of the City
to accept the dedication to public use of Fieldstone
Drive as a public street.
BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana, that
the City of Bozeman hereby accepts the conveyance and
dedication to the use of the public
forever of Fieldstone Drive, for a public street, the
land included in Fieldstone Drive as shown
on the plat of Westfield Subdivision, more particularly
described as follows:
Commencing at the East Quarter corner of Section 24,
Township 2 South,
Range 5 East of the Principal Meridian of Montana, City
of Bozeman,
Gallatin County, Montana, said point being the Northeast
corner of said
Westfield Subdivision.
Thence South 08057'34" West, a distance of
197.79 feet to the intersection of the north right-of-way
line of Fieldstone
Drive with the west right-of-way line of Wagon Wheel
Road, said point
being the True Point of Beginning.
Thence around the perimeter of
Fieldstone Drive, as shown on the plat of Westfield
Subdivision the
following courses: South 89017'33" West, a distance
of 304.06 feet to

a point of curve. Thence along a 222.50 foot radius curve to the left,
through a central angle of 15000'00", an arc distance of 58.25 feet.
Thence South 74017'33" West, a distance of 74.63 feet to a point of
curve. Thence along a 177.50 foot radius curve to the right, through a
central angle of 30000'00", an arc distance of 92.94 feet. Thence North
75042'27" West, a distance of 74.63 feet to a point of curve. Thence
along a 222.50 foot radius curve to the left, through a central angle of
15000'00" an arc distance of 58.25 feet. Thence, South 89017'33"
West, a distance of 289.92 feet to a point of curve. Thence along a
172.50 foot radius curve to the left, through a central angle of
77047'33", an arc distance of 234.22 feet. Thence South 78030'00"
East, a distance of 45.00 feet. Thence along a 127.50 foot radius curve
to the right, the tangent to which bears North 11030'00" East, through
a central angle of 77047'33", an arc distance of 173.12 feet. Thence
North 89017'33" East, a distance of 289.92 feet to a point of curve.
Thence along a 177.50 foot radius curve to the right, through a central
angle of 15000'00", an arc distance of 46.47 feet. Thence South
75042'27" East, a distance of 74.63 feet to a point of curve. Thence
along a 222.50 foot radius curve to the left, through a central angle of
30000'00", an arc distance of 116.50 feet. Thence North 74017'33"
East, a distance of 74.63 feet to a point of curve. Thence along a 177.50
foot radius curve to the right, through a central angle of 15000'00", an
arc distance of 46.47 feet. Thence North 89017'33" East, a distance of
303.32 feet to a point on the west right-of-way line of Wagon Wheel
Road. Thence North 00014'07" East along said west right-of-way line,
a distance of 45.00 feet to the True Point of Beginning. Said tract of land
being 1.1942 acres.
PROVISIONALLY PASSED AND ADOPTED by the City Commission of the City of
Bozeman, Montana, at a r~gular session thereof held on the 23rd day of November 1992.
