ORDINANCE NO. 1368
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF
BOlEMAN, MONTANA, AMENDING
THE ZONING DISTRICT
DESIGNATION FROM "R-S" (RESIDENTIAL--SUBURBAN)
TO " B-2"
(COMMUNITY BUSINESS) ON 14.2
ACRES LOCATED IN THE
NORTHEAST % OF SECTION 1, TOWNSHIP 2 SOUTH, RANGE 5 EAST,
MONTANA PRINCIPAL MERIDIAN, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map change has been properly submitted, reviewed
and advertised in accordance with the procedures of the Bozeman zoning ordinance, dated
August 19, 1991; and
WHEREAS, the City-County Planning Board held a public hearing on December 15,
1992, to receive and review all written and oral testimony on the requested zone map
change; and
WHEREAS, the City-County Planning Board recommended to the Bozeman City
Commission that the requested Zone Map Amendment from an "R-S" designation to a "B-2"
designation be approved; and
WHEREAS, the applicants requested that the City-County Planning Board's
recommendation of a "8-2" zoning designation be approved by the City Commission; and
WHEREAS, the City Commission held a public hearing on January 19, 1993, to
receive and review all written and oral testimony on the request for a zone map change; and
WHEREAS, the City Commission has reviewed and considered the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
change to be in compliance with the twelve criteria; and

WHEREAS, the City Commission finds that the proposed zone map change to "B-2"
would bring the zoning of the property into compliance with the Bozeman Area Master Plan
and would be in the public interest.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana:
That the zoning district designation of the following-described 14.2 acre property
is hereby changed from an "R-S" (Residential Suburban) to a "B-2" (Community Business):
A tract of land located within the Northeast one-quarter of Section 1,
Township 2 South, Range 5 East, Montana Principal Meridian, Gallatin
County, Montana, and being further described as follows;

Beginning at a point which is N 47043'55" W a distance of 69.65 feet
from the east % corner of said ,Section 1, said point also being the
northerly right-of-way line of West Oak Street; thence from said true point
of beginning along said right-of-way line N 87058'40" W a distance of
470.01 feet to the SE corner of the tract of land annexed to the City of
Bozeman under Commission Resolution No. 2860; thence along the
easterly and a portion of the
northerly line of said annexation
N 01 016'30" E a distance of 523.00 feet to the NE corner of said
annexation; thence along the northerly line of said tract N 88043'30" W
a distance of 223.71 feet to a point of the east line of Westlake's 3rd
Addition; thence along said line N 00056'43" E a distance of 562.55 feet
to the NE corner of said tract, said point also being the southerly right-of-
way line
of Interstate 90; thence along
said right-of-way line
N 87000'01" E a distance of 231.18 feet and S 72016'02" E a distance
of 486.31 feet; thence S 01 0 16'30" Wa distance of 971.12 feet to the
point of beginning. Said tract being 14.147 ares along with and subject
to any existing easements.
