A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, APPROVING ALTERATION/MODIFICATION OF CONTRACT WITH
TRAPPER PEAK CONSTRUCTION INC., WILLOW CREEK, MONTANA.
WHEREAS, the City Commission did, on the 11th day of November 2008, authorize award of the
bid for the Landfill Final Closure project, to Trapper Peak Construction, Inc., Willow Creek, Montana; and
WHEREAS, Section 7-5-4308, Montana Code Annotated, provides that any such alterations or
modifications of the specifications andlor plans of the contract be made by resolution; and
WHEREAS, it has become necessary in the prosecution of the work to make alterations or
modifications to the specifications and/or plans of the contract.
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman,

Montana, that the proposed modifications andlor alterations to the contract between the City of Bozeman, a
municipal corporation, and, Trapper Peak Construction Inc., as contained in Change Order No. 2, attached
hereto, be and the same are hereby approved; and the City Manager is hereby authorized and directed to
execute the contract change order for and on behalf of the City; and the City Clerk is authorized and
directed to attest such signature.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a regular

You are directed to make the following changes in the Contract Documents:
Description:
Hand picking the litter from the compost provided by the City. Payment will be made based on personnel hours
and use of a recovery cart and ATV. The cost for this item is $1,500 and requires 2 additional contract days.
Placement of additional soil along the east side of the landfill to eliminate the old access road as requested by City.
The cost for this item is $3,500 and required an additional 2 contract days.
Reclamation of the City's borrow area including 6" of topsoil, seeding, fertilizing, and erosion control. Also
included in this item is the aesthetic landscaping features including softening the slope face on the south boundary
of the current borrow area as requested by the City. The cost for this item is $47,600 with an additional 30 contract
days required.
Fill of the rill on the Class IV area as requested by the City. The cost for this item is $1,500 with one day of
additional contract time required.
Reason for Change Order:
Additional soil placed along the east side of the landfill, the reclamation of the City's borrow area, and the fill of
the Class IV rill are all additional work items requested by the City.
The hand picking of the waste from the compost provided by the City is required to meet closure certifications.

CHANGE ORDER
INSTRUCTIONS
A. GENERAL INFORMATION
This document was developed to provide a uniform format for handling contract changes that affect Contract Price
or Contract Times. Changes that have been initiated by a Work Change Directive must be incorporated into a
subsequent Change Order if they affect Price or Times.
Changes that affect Contract Price or Contract Times should be promptly covered by a Change Order. The practice
of accumulating Change Orders to reduce the administrative burden may lead to unnecessary disputes.
If Milestones have been listed in the Agreement, any effect of a Change Order thereon should be addressed.
For supplemental instructions and minor changes not involving a change in the Contract Price or Contract Times, a
Field Order should be used.
B. COMPLETING THE CHANGE ORDER FORM
Engineer normally initiates the form, including a description of the changes involved and attachments based upon
documents and proposals submitted by Contractor, or requests from Owner, or both.
Once Engineer has completed and signed the form, all copies should be sent to Owner or Contractor for approval,
depending on whether the Change Order is a true order to the Contractor or the formalization of a negotiated
agreement for a previously performed change. After approval by one contracting party, all copies should be sent to
the other party for approval. Engineer should make distribution of executed copies after approval by both parties.
If a change only applies to price or to times, cross out the part of the tabulation that does not apply.

RE: City of Bozeman Landfill Closure- Project Status Update
Dear Dustin:
I conducted a inspection of the landfill closure project on August 3, 2009 and
met on-site with Riley and Sheila Malone of Trapper Peak Construction as well
as Steve Johnson and Shad Bare of the City. This letter summarizes my
findings and recommendations.
Main Landfill Area
The ET layer has been placed over the entire closure area, tested and accepted
by Great West. Trapper Peak has placed the topsoil and compost on most of
the closure area except a small area west of the topdeck access road. Trapper
Peak will blade the landfill closure area one more time in preparation for
seeding, fertilizing and placement of the straw wattles. The seeding and straw
wattles will not be completed until this fall so that the site can be seeded
dormantly. The specifications call for fall seeding not to be conducted until after
October 15th. We will monitor weather conditions and give Trapper Peak
authorization to proceed with the seeding once conditions are appropriate.
The compost provided by the City has a significant amount of waste in it.
Trapper Peak has provided an estimate for hand picking the litter from the
compost prior to seeding for $1,500. This has been enclosed in the attached

Other punchlist items for the main landfill area include extension of the well
casings and leachate collection cleanouts and construction of the lysimeter.
Soil Borrow Areas
Reclamation of the borrow area utilized by Trapper Peak for this project and by
Shumaker under the previous closure project is part of the contract and the City
would like to have Trapper Peak proceed with this work. An additional soil
borrow area utilized by the City during their landfill operations is located
immediately west of the contractor's borrow area. Trapper Peak has provided
an estimate of $47,600 for the reclamation of the borrow area. We are
recommending approval of this change order request and it is enclosed in the
attached Change Order #2.
Class IV Rill
The City requested that Trapper Peak fill a rill on the existing Class IV area.
The estimate of $1,500 was approved by Great West Engineering and the City
and work has been completed. This item is included in Change Order #2.
Asbestos Pit
The City requested that Trapper Peak fill the remainder of the space in the
asbestos pit with soil stockpiled from the pit excavation. Trapper Peak provided
a unit price estimate and a quantity for this work which has been completed.
The estimate provided by Trapper Peak included not only placement of the fill
but reclamation of the stockpile area and the borrow area used by Envirocon
during the placement of asbestos waste. Reclamation of the stockpile and
borrow area includes approximately 2 acres of regarding, topsoil placement and
seeding. Placement of the fill in the asbestos pit required Trapper Peak to
handle the material several times to complete the work which also increased
the cost of this work. Trapper Peak has agreed to submit a detailed justification
for the $11.75/cubic yard amount provided in their estimate.
The City has also requested that the quantity of 12,480 cubic yards estimated
by Trapper Peak be verified. This will be accomplished by potholing down to
the waste to determine the depth of cover. Trapper Peak has agreed to provide
their 330 excavator to excavate these test pits at $225/hour. It is estimate that
the test pits can be excavated in 4 -6 hours. Great West will log the pits and
estimate the final quantity from this information.
If Great West and the City accept the final justification for the unit price and the
final quantity, this work will be rolled into a change order.
