ORDINANCE NO. 1562
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA,
AMENDING THE
CITY OF BOZEMAN
ZONE MAP AND
ESTABLISHING AN INITIAL MUNICIPAL ZONING DESIGNATION OF "R~3-A"
(RESIDENTIAL TWO FAMll V, MEDIUM DENSITY DISTRICT) ON 1.87 ACRES
lOCATED IN THE NEY4 OF SECTION 11, T2S, R5E, PMM, GALLA TIN COUNTY,
MONTANA.
WHEREAS, the proposed zone map amendment to establish an initial zoning designation of
"R-3A", Residential Two Family, Medium Density District, on 1.87 acres has been properly submitted,
reviewed and advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on April 3, 2001,
to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on May 7, 2001,
to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, one adjacent property owner spoke in opposition to said rezoning at the public
hearing; and
WHEREAS, the City received written protest from the same property owner and signed by
seventeen real property owners of record, adjacent to the area to be zoned, opposing the change
in
zoning; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria
established in Section 76-2-304, M.C.A., and found the proposed zone map amendment, to be in
compliance with the twelve criteria; and
WHEREAS, at its meeting held on May 7,2001, the City Commission found that the proposed
zone map amendment, as recommended by the Zoning Commission, would be in compliance with the
Bozeman Area Growth Policy and would be in the public interest, contingent upon annexation; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution No.
3514, adopted on the 25th day of March, 2002.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:

That
the zoning district designation of the following-described property is hereby designated
as "R-3-A" (Residential-- Two-Family, Medium-Density District):
A
tract of land located in the Northeast 1/4 of Section 11, Township 2 South, Range
5
East, Principal Meridian Montana, Gallatin County, Montana. Commencing at a
point
on the West line of said Northeast 1/4, which bears SOoo31'46"W a distance of
712.39
feet, from the northwest corner of said Northeast 1/4 (North 1/4 corner

11) to the true point of beginning; thence N87039'30"E, a distance of 172.64
feet;
thence SOoo47'46"W, a distance of497.24 feet; thence N77046'33"W, a distance
of
173.71 feet; thence NOoo31'46"E, a distance of 453.38 feet to the true point of
beginning;
said parcel containing 1.87 acres including a 60-foot access and utilities
easement
along the north line of the above described tract.

The
effective date is thirty days after final adoption of this ordinance on second reading.

by the City Commission of the City of Bozeman, Montana on first reading at a regular
session thereof held on the 25th day of March 2002.
