*Consider a motion approving the Regular Meeting Minutes from August 3, 2009 and
August 10, 2009 as submitted.
E. Consent
1. Authorize Payment of Claims (LaMeres)
2. Authorize City Manager to sign a Non-exclusive Access and Utility
Easement across land owned jointly by Gallatin County and the City of
Bozeman, requested by Global Tower Assets, LLC. (Cooper)
3. Authorize City Manager to sign a Five-year Service Contract with Otis
Elevator for Elevators at the Professional Building and the Senior Center
with the price per month at the Professional Building being $157.55 and
the price per month at the Senior Center being $151.14 (Goehrung)
4. Authorize City Manager to sign a Service Agreement with Simplex
Grinnell in the amount of $720.00 for the Inspection of Fire Sprinkler
Systems in City owned Buildings (Goehrung)
5. Approve the Monthly Building Report for August, 2009 (Risk)
6. Approve Opening and Continuing the Budget Hearing to September 28,
2009 (Rosenberry)

G. Action Items
1. Provisional Adoption of Ordinance No. 1767, amending Title 6 by adding
section 6.04.070 regulating the keeping of domestic chickens within the
corporate limits of the City of Bozeman AND amending Title 18 section
18.80.080 defining agricultural activity (Public Hearing) (Fontenot)
*Consider a motion Provisionally Adopting Ordinance No. 1767, amending Title 6 by
adding section 6.04.070 regulating the keeping of domestic chickens within the
corporate limits of the City of Bozeman.
AND
*Consider a motion Amending Title 18 section 18.80.080 defining agricultural activity.
AND
*If approved, consider directing Staff to return to the Commission during the 30-day
effective period with a chicken keeping permit fee resolution.
2. Community Climate Action Plan Process (Open and Continued from
August 31, 2009) (Meyer)
*Consider a motion approving the steps outlined in the Community Climate Action Plan
Process.
3. Site Plan Certificate of Appropriateness with Partial Demolition,
Application No. Z-09145 for 332 South Church Avenue (Public Hearing)
(Kramer)
*Consider a motion approving partial demolition of a contributing structure within the
Neighborhood Conservation Overlay District.
AND
*Consider a motion approving construction of a second floor on the existing single floor
residence.
AND
*Consider a motion approving demolition of the existing garage.
AND
*Consider a motion approving construction of a new 1,080 square foot, two story second
residential building in the rear yard; and related site improvements, Application No. Z-
09145.

4. Provisional Adoption of Ordinance No. 1773: Authorizing the City
Manager to enter into a 99-year Ground Lease with the Human Resource
Development Council, Inc. for the Lease of a .539-acre Parcel for the
purpose of Developing a Public Transportation Storage and Repair
Facility (Public Hearing) (Sullivan)
*Consider a motion to Provisionally Adopt Ordinance No. 1773, authorizing the City
Manager to enter into a 99-year Ground Lease with the Human Resource Development
Council, Inc. for the Lease of a .539-acre Parcel for the purpose of Developing a Public
Transportation Storage and Repair Facility.
5. Memorandum of Understanding with Human Resource Development
Council, Inc. (HRDC) for the Joint Development of City Land for the City
of Bozeman Vehicle Maintenance and HRDC Bus Storage Joint Facility
(Arkell)
*Consider a motion authorizing the City Manager to sign a Memorandum of
Understanding with the Human Resource Development Council, Inc. (HRDC) for the
Joint Development of City Land for the City of Bozeman Vehicle Maintenance and HRDC
Bus Storage Joint Facility.
6. Montana State University Residential Parking District Boundary as
defined by Title 10.32.395 (Opened and Continued from August 10,
2009) (Burns)
*Consider a motion directing Staff to bring back to the Commission a Clarification of the
Montana State University Residential Parking District Boundary as defined by Title
10.32.395.
7. Provisional Adoption of Ordinance No. 1771, Increase of Fine Amount for
Parking Citation for 48 hour/5 day Parking Violations, and for other
Violations of Title 32 (Public Hearing) (Opened and Continued from 8-
24-09) (Burns)
*Consider a motion opening the Public Hearing for the Provisional Adoption of
Ordinance No. 1771.
AND
*Consider a motion to Provisionally Adopt Ordinance No. 1771, Increase of Fine
Amounts for Parking Citation for 48 hour/5 day Parking Violations, and for other
Violations of Title 32.
8. Lease of Law & Justice Center Space for Second Municipal Court (Winn)
*Consider a motion Authorizing the City Manager to sign an Agreement with Gallatin
County to lease 1710 square feet within the Law & Justice Center for Second Municipal

Court, subject to minimal changes for legal review.
9. Appointment to the Tree Advisory Board (Kissel)
*Consider a motion appointing up to one new member to the Tree Advisory Board.
