ORDINANCE NO. 1397
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, PROVIDING
THAT THE BOZEMAN
MUNICIPAL CODE BE
AMENDED BY
REVISING SECTION 1 O.32.030.A.
7. OF SAID
CODE,
PROVIDING THAT THE DISTANCE FOR PARKING
FROM A FLASHING
BEACON, STOP SIGN OR TRAFFIC CONTROL SIGNAL BE INCREASED FROM
TWENTY FEET TO THIRTY FEET.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana:
Section 1
That Section 10.32.030 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
"10.32.030 Stoppina, standina or parkinQ--Locations
where prohibited.
A. No person shall stop, stand or park a vehicle,
except when necessary to avoid
conflict with other traffic or in compliance
with law or the directions of a police
officer or traffic-control device, in any of
the following places (no signs are
required) :
1 .
On a sidewalk;
2.
In front of a public or private driveway;
3.
Within an intersection;
4.
Within fifteen feet of a fire hydrant, except where parking areas
are designated and plainly marked by direction of the director
of public safety;
5.
On a crosswalk;
6.
Within twenty feet of a crosswalk at an intersection, except
where parking areas are designated and plainly marked by
direction of the director of public safety;
7.
Within twenty tqif~y feet upon the approach to any flashing
beacon, stop sign or traffic-control signal located at the side of
a roadway, except where parking areas are designated and
plainly marked by direction of the director of public safety;
8.
Between a safety zone and the adjacent curb, or within thirty
feet of points on the curb immediately opposite the ends of a
safety zone, unless the director of public safety has indicated
a different length by signs or markings;
9.
Within fifty feet of the nearest rail of a railroad crossing, except
where parking areas are designated and plainly marked by
direction of the director of public safety;
10.
Within twenty feet of the driveway entrance to any fire station
and on the side of a street opposite the entrance to any fire
station within seventy-five feet of such entrance when properly
signposted, except where parking areas are designated and
plainly marked by direction of the director of public safety;
11 .
Alongside or opposite any street excavation or obstruction
when stopping, standing or parking would obstruct traffic;
12.
On the roadway side of any vehicle stopped or parking at the
edge or curb of a street;
13.
Upon any bridge or other elevated structure upon a highway,
or within a highway tunnel;
14.
At any place where official signs or markings prohibit stopping
or parking.
B. No person shall move a vehicle not lawfully
under his control into any such
prohibited area or away from a curb such distance
as is unlawful."
Section 2
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this ordinance
which may be given effect without the invalid provision or application and, to this end, the
provisions of this ordinance are declared to be severable.
Section 4
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that begun before the effective date of this
ordinance.
Section 5
Effective Date.
This ordinance shall be in full force and effect thirty (30) days after final adoption on
second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at
a regular session thereof held on the 21 st day of February 1995.
