These are in regards to Tetra Tech's professional services contract for the CMC Bozeman Asbestos Site Voluntary Cleanup Project. FROM: City of Bozeman WORK AUTHORIZATION NO.: TTGFIHO*-077 PROJECT TITLE: CMC Bozeman Asbestos Site Voluntary Cleanup Plan 2009 Addendum Construction Oversight. PROJECT LOCATION: CMC Bozeman Asbestos Site, South Wallace Avenue, Bozeman, MT Pursuant to the terms and conditions of the Inter-Corporate Agreement dated June 5, 2006, this Work Order hereby authorizes specific services to be performed and under the particular conditions set forth herein: 1. SCOPE OF WORK: Tetra Tech is providing inspection and testing services during implementation of the Voluntary Cleanup Plan for the CMC East Main Depot Facility Addendum (VCP) dated December 15, 2008. Envirocon was contracted by the City to implement the VCP. Tetra Tech will make reasonable efforts to perform the required work as required by the VCP and DEQ, however, if unforeseen "Good Cause" conditions (as defined in Montana Code Annotated 75-10-746(9) Tetra Tech will perform those required tasks in an expedited manner as soon as reasonably achievable. The services to be provided by Tetra Tech include the three tasks that were included in Work Authorization Number TTGFIHO*-076, however, this modification addresses additional expenses associated with the longer time period Tetra Tech has been required to provide project oversight. The additional expenses are related to the following: • Additional oversight days associated with the larger volume of asbestos contaminated soil that has been removed from the property; • Additional work related to preparation of change orders (i.e., engineering design for Wallace Avenue Drainage, Empire Building Material's fence removal and replacement, Underground Storage Tank removal, Heeb's Alley Excavation Plan); • Additional asbestos analytical costs for soil samples at $200 per sample. • Additional oversight days associated with Envirocon's implementation of the change orders; • Additional oversight days associated with weather delays; • Additional effort to address change orders in Construction Completion Report; and, • Anticipated additional time to respond to DEO comments on Construction Completion Report. 2. COMPENSATION: The approved amount of this work Order is $95,000 based on the attached Tetra Tech 2009 Time & Material Schedule of Charges. Prior written authorization from Client's project manager will be required to exceed the above amount. 3. BILLING SCHEDULE: Monthly 4. TIME FOR COMMENCEMENT: February 1, 2009 5. TIME FOR COMPLETION: July 31, 2009 Our schedule will primarily be controlled by the City's contractor; hence, the estimated times listed in Section 1. Scope of Work, are subject to change. The draft construction completion report will be completed and submitted to DEQ for review within two weeks of the City's contractor completing the soil removal portion of the project or one day after final backfilling and paving is completed, whichever comes later. Our construction completion report cannot be submitted to DEQ until the backfill and paving task is completed since it must state that these activities have been completed. The final construction completion report will be submitted within six days of our receipt of DEO's comments on the draft report. Minor revegetation monitoring activities will continue after final receipt of funds from DEQ. Work Authorization June 24, 2009 Page 2 of 2 6. REPORTING REQUIREMENTS: Draft and Final Construction Completion Report. 7. OTHER PROVISIONS: Performance of contract based on DEQ approval of excavated areas being free of asbestos and their response to documents created. Upon execution of this Work Order, Client and Tetra Tech agree to bound by and comply with all the terms and conditions contained in the above referenced Inter Master Consulting Services agreement, except as modified by the specific terms and conditions, if any, contained herein.
