RELEASE AND RECONVEYANCE OF EASEMENT
COMES NOW the West Winds Master Homeowners' Association, Inc., P.O. Box 1501,
Bozeman, MT 59771, hereinafter ("GRANTOR") and does hereby release and reconvey the
following described easement unto City of Bozeman, 121 N. Rouse, Bozeman, Montana 59715,
hereinafter ("GRANTEE"), as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Temporary Storm Drainage
Easement recorded as Document No. 2311603, Records of the Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tract of land located in the Northwest Quarter of
Section 2, Township 2 South, Range 5 East, P.M.M, Gallatin County, Montana, in West Winds
Major Subdivision Phase 2A, as described in Records of the Clerk and Recorder, Gallatin
County, Montana.
WHEREAS the above Temporary Storm Drainage Easement was granted on September
29, 2008 and recorded on September 30, 2008 at the Clerk and Recorder's Office of Gallatin
County, Montana, and
WHEREAS the storm drainage facility will be relocated during construction for the
improvements to West Winds Phase 5 Subdivision and the use of said easement recorded on
September 30, 2008 was temporary for public storm drainage purposes until construction of the
Phase 5 improvements, the vacation of said easement will not adversely impact the Grantor's
interests.
WHEREFORE, the Grantor does hereby release and reconvey to the City of Bozeman
said easement recorded on September 30, 2008 together with any right, title, or interest that the
Grantor may have in said easement.
