Municipal Corporation of the State of Montana hereinafter ("GRANTOR") and does hereby
release and reconvey the following described easement unto Norton Properties, LLC, of 63020
Lower Meadow Road, Suite 200, Bend, Oregon 97701, hereinafter ("GRANTEE"), as follows:
WITNESSETH
WHEREAS the Grantor is the legal record title holder of a Public Street and Utility
Easement recorded as Document No. 2269583, Records of the Clerk and Recorder, Gallatin
County, Montana, situated across the Grantee's tracts of land being the SE 1/a of the NW 1/a, SW
'/a of the NE 1/a, NE 1/a of the SW 1/a, NW 1/a of the SE'/a, all in Section 9, Township 2 South,
Range 5 East, P.M.M, Gallatin County, Montana.
WHEREAS the above Public Street and Utility Easement was granted on May 7, 2007
and recorded on June 15, 2007 at the Clerk and Recorder's Office of Gallatin County, Montana,
and
WHEREAS the construction of the improvements will be done in a future phase of the
subdivision, the vacation of said easement will not adversely impact the Grantor's interests.
WHEREFORE, the Grantor does hereby release and reconvey to Norton Properties, LLC
said easement recorded on June 15, 2007 together with any right, title, or interest that the Grantor
may have in said easement.
