ORDINANCE NO. 1399
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY
OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING
DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION
FROM "A-S"
(AGRICUL TURE--SUBURBAN) AND "R-S" (RESIDENTIAL--SUBURBAN)
TO
"BP" (BUSINESS PARK) ON 13.4247 ACRES KNOWN
AS TRACT 1,
CERTIFICATE OF SURVEY NO. 1224, LOCATED IN THE
SOUTHWEST
ONE-QUARTER OF SECTION 32, TOWNSHIP 1 SOUTH,
RANGE 6 EAST,
MONTANA PRINCIPAL MERIDIAN.
WHEREAS, the proposed zone map amendment has
been properly submitted,
reviewed and advertised in accordance with the procedures of the Bozeman Municipal Code;
and
WHEREAS, the City-County Planning Board held
a public hearing on February 15,
1994, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City-County Planning Board recommended
to the Bozeman City
Commission that the requested zone map amendment be approved; and
WHEREAS, the City Commission held a public hearing
on February 22, 1994, to
receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Commission has reviewed and
considered the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
amendment to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on February 22,
1994, the City Commission found
that, upon annexation, the proposed zone map amendment would be in compliance with the
Bozeman Area Master Plan and will be in the public interest; and
WHEREAS, on the 1 st day of May 1995, the City
Commission adopted Commission
Resolution No. 3057, annexing the parcel included in this zone map amendment.
NOW, THEREFORE, BE IT ORDAINED by the City Commission
of the City of
Bozeman, Montana:
Section 1
That the zoning district designation of the
following-described property is hereby

"A-S" (Ag ricu Itu renS u bu rba n) and
"R-S" (Resid entialnSu burban) to
"BP"(Business Park):
Tract 1, Certificate of Survey No. 1224, located in the Southwest one-
quarter of Section 32, Township 1 South, Range 6 East, Montana Principal
Meridian, Gallatin County, Montana.
Section 2
The effective date is thirty days after final adoption of this ordinance on second
reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading,
at a regular session thereof held on the 15th day of May 1995.
