ORDINANCE NO. 1402
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "A.S"
(AGRICUL TURE--SUBURBAN) TO "PLI" (PUBLIC LANDS AND INSTITUTIONS) ON
28.759 ACRES LOCATED IN THE SOUTHWEST ONE-QUARTER OF THE
SOUTHEAST ONE-QUARTER OF SECTION 24, TOWNSHIP 2 SOUTH, RANGE
5 EAST, MONTANA PRINCIPAL MERIDIAN.
WHEREAS, the proposed zone map amendment has been properly submitted, reviewed
and advertised in accordance with the procedures of the Bozeman Municipal Code; and
WHEREAS, the City-County Planning Board held a public hearing on March 1, 1994, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City-County
Planning Board recommended to the Bozeman
City
Commission that the requested zone map amendment be approved; and
WHEREAS, the City Commission opened the public hearing at its meeting held on March
21, 1994, at which time it was continued; and
WHEREAS, after proper notice, the City Commission held its public hearing on August 15,
1994, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment
to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on August 15, 1994, the City Commission found that, upon
annexation, the proposed zone map amendment would be in compliance with the Bozeman Area
Master Plan and would be in the public interest; and
WHEREAS, on the 3rd day of July 1995, the City Commission adopted Commission
Resolution No. 3068, annexing the parcel included in this zone map amendment.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby amended
from "A-S" (AgricultureuSuburban) to "PlI"(Public Lands and Institutions):
A tract of land located in the southwest one-quarter of the southeast one-
quarter of Section 24, Township 2 South, Range 5 East, Montana Principal
Meridian, which is on file and of record in the Office of the Clerk and Recorder,
Gallatin County, Montana. Said tract is more particularly described as follows:
Beginning at Corner No. 1 of said parcel, which is identical with the south
quarter corner of Section 24, and is marked with a marked sandstone post;
thence, from Corner 1, North 00013'30" East along the west line of the

southeast quarter of Section 24 a distance of
990.06 feet to Corner No.2,
which is marked with a brass capped iron monument;
thence, from Corner No.
2, North 89037' 13" East a distance of 1264.61
feet to Corner No.3, which is
marked with a brass capped iron monument on
the west right-of-way line of the
Chicago, Milwaukee, St. Paul and Pacific Railroad;
thence from Corner No.3,
South 00008'05" West along the said west right-of-way
line a distance of
990.04 feet to Corner No.4, which is marked
with a brass capped iron
monument on the south line of the southeast
quarter of Section 24; from Corner
NO.4 the southeast corner of the southwest quarter
of the southeast quarter of
Section 24 which is marked with a county cast
iron monument, bears North
89037' 13" East a distance of 63.33 feet; thence
from Corner No.4, South
89037' 13" West along the south line of the
southeast quarter of Section 24 a
distance of 1266.17 feet to Corner No.1.
Section 2
The effective date is thirty days after final
adoption of this ordinance on second reading.
PASSED by the City Commission of the City of
Bozeman, Montana, on first reading, at a
regular session thereof held on the 3rd day of July 1995.
