ORDINANCE NO. 1403 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "R-S" (RESIDENTIAlnSUBURBAN) TO "R-3a" (RESIDENTIAl--TWO-FAMll Y, MEDIUM-DENSITY) ON 3.557 ACRES KNOWN AS TRACT A OF CERTIFICATE OF SURVEY NO. 573, lOCATED IN SECTION 13, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. WHEREAS, the proposed zone map amendment has been properly submitted, reviewed and advertised in accordance with the procedures of the Bozeman Municipal Code; and WHEREAS, the City-County Planning Board held a public hearing on May 3, 1994, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City-County Planning Board recommended to the Bozeman City Commission that the requested zone map amendment be approved; and WHEREAS, the City Commission held its public hearing on May 16, 1994, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on May 15, 1994, the City Commission found that, upon annexation, the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and would be in the public interest; and WHEREAS, on the 15th day of May 1995, the City Commission adopted Commission Resolution No. 3059, annexing the parcel included in this zone map amendment. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby amended from "R-S" (Residential--Suburban) to "R-3a"(ResidentialnTwo-family, Medium- density) : u. - A tract of land known as Tract A of Certificate of Survey No. 573, located in Section 13, Township 2 South, Range 5 East, Montana Principal Meridian, which is on file and of record in the Office of the Clerk and Recorder, Gallatin County, Montana, and more commonly located along the north side of the 1800 block of Kagy Boulevard. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
