SUBJECT: Public Hearing and Provisional adoption of Ordinance 1768, adopting
change to MSU Residential Parking District as defined by Title 10.32.395 and subsequent
ordinances.

RECOMMENDATION: Approve Opening and Continuing the Public Hearing and Provisional
adoption of Ordinance No. 1768 change to MSU Residential Parking District as defined by Title
10.32.395 and subsequent ordinances to a future date determined by Staff.
BACKGROUND: Ordinance 1768 that would exclude a block of South 8th Avenue in front
of Irving School from the Montana State University Parking District was originally scheduled
and advertised for a public hearing and provisional adoption on August 10.
However, in researching the original ordinance that created the MSU Parking District in 1994,
and the ordinances that have come since, it’s been discovered that not all subsequent ordinances
were properly documented.
Per the attached email from city engineer Brian Heaston, I am requesting that this ordinance
remain Open and Continue until August 17.
FISCAL EFFECTS: The district is designed to be self-sustaining.
ALTERNATIVES: As suggested by the City Commission.

NOTICE TO BOZEMAN RESIDENTS
NOTICE IS HEREBY GIVEN that the City Commission will conduct a
public hearing at 6:00 p.m. on Monday, August 10, 2009, in the Commission
Room, City Hall, 121 North Rouse Avenue, Bozeman, Montana, for the purpose
of receiving public input on the possible adoption of an ordinance which
eliminates street frontages to the MSU Residential Parking District in response to
a request filed by the administration of Irving School and also clarifies the district
description. The specified street is generally described as:
THE WEST SIDE OF SOUTH 8TH AVENUE BETWEEN WEST ALDERSON
AND WEST DICKERSON AVENUES;
This location is depicted as dashed lines on the map below.

Copies of the ordinance and street proposed for exclusion in the
neighborhood parking district are available in the office of the City Clerk, City

Hall, 121 North Rouse Avenue, or you may call 582-2320 during regular business
hours.
Any interested parties are invited to submit written testimony or attend
the public hearing and provide testimony in support of or in opposition to the
proposed exclusion to the MSU Residential Parking District.
