HomeMy WebLinkAboutOrdinance 98- 1465 Rezone (27) -~-- -~. ---.-- ~_. ........,.....---..- - n.._. _ _ .__ -..----......-- -.- .--...-- f~iIJI"~ , ... ... ~ -", ORDINANCE NO. 1465 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "R-4" (RESIDENTIAL--HIGH DENSITY) TO "R-O" (RESIDENTIAL--OFFICE) ON 14.59 ACRES IN THE SOUTHWEST ONE-QUARTER OF SECTION 13, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL MERIDIAN. WHEREAS, the proposed zone map amendment from "R-4", Residential--High- density, to "R-O", Residential--Office, has been properly submitted, reviewed and advertised; and WHEREAS, the City-County Planning Board held a public hearing on July 15, 1997, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City-County Planning Board forwarded no formal recommendation to the Bozeman City Commission regarding the proposed zone map amendment from "R-4", Residential--High-density, to "R-O", Residential--Office; and WHEREAS, after proper notice, the City Commission held its public hearing on August 4, 1997, to receive and review all written and oral testimony on the request for a zone map amendment; and WHEREAS, the City Commission has reviewed and considered the twelve zone change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment to be in compliance with the twelve criteria; and WHEREAS, at its meeting held on August 4, 1997, the City Commission found that the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and would be in the public interest. NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the zoning district designation of the following-described property is hereby amended from "R-4" (Residential--High-density) to "R-O" (Residential-~Office): A tract of land located at the southwest corner of the intersection of South 11th Avenue extended and Kagy Boulevard, and more particularly described as follows: -,- .~ - , Lot 18, Amended Subdivision No. 1-1-A, and Lot 2, Boylan's Addition No. 1, located in the Southwest one-quarter of Section 13, Township 2, South, Range 5 East, Montana Principal Meridian. Section 2 The effective date is thirty days after final adoption of this ordinance on second reading.
