ORDINANCE NO. 1479
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED BY
REVISING SECTIONS 18.04.650,
18.50.035 AND 18.50.060,
BY ADDING
SECTIONS 18.04.105,
18.04.655, 18.04.665, 18.04.885,
18.04.1465,
18.04.1485, AND 18.04.1605, AND BY ADDING CHAPTER 18.57 TO PROVIDE
FOR THE REGULATION OF TELECOMMUNICATIONS TOWERS.
WHEREAS. the proposed zone code amendment has been properly submitted. reviewed and
advertised; and
WHEREAS, the City-County Planning Board held a public hearing on September 1. 1998. to
receive and review all written and oral testimony on the proposed zone code amendment; and
WHEREAS. the City-County Planning Board recommended to the Bozeman City Commission
that the zone code amendment be approved; and
WHEREAS. after proper notice. the City Commission held its public hearing on September
21. 1998. to receive all written and oral testimony on the proposed zone code amendment; and
WHEREAS. the City Commission has reviewed and considered the twelve zone code
amendment criteria established in Section 76~2-304. M.C.A.. and found the proposed zone code
amendment. as recommended by the City~County Planning Board. to be in compliance with the
twelve criteria; and
WHEREAS, at its meeting held on September 21. 1998. the City Commission found that the
proposed zone code amendment would be in compliance with the Bozeman Area Master Plan and
would be in the public interest.
NOW, THEREFORE. BE IT ORDAINED by the City Commission of the City of Bozeman.

Section 10
That Subsection E of Section 18.50.060 of the Bozeman Municipal Code be amended so
that such Subsection 18.50.060.E. shall read as follows:
"18.50.060 Yard and height encroachments, limitations and exceptions.
E. Height Limitation Exceptions.
1. Non-Specific Exemptions.
No building, or part thereof, or
structure shall be erected, reconstructed,
or structurally altered
to exceed in height the limit herein
designated for the district in
which such building is located, except
as is specified in Chapter
18.66, or as specifically authorized
by the Planning Board as an
approved condition of a planned unit
development. Such
approved conditions must include
the recommendations of the
City Fire Marshalk
2. Specific Exemptions.
a.
Height limitations shall not apply to church spires,
belfries, cupolas and
domes; monuments;
chimneys and smokestacks; flag poles; public and
private utility facilitiest-/ transmission towers of
commercial and private radio-broadcasting

feet above the limiting height of the building
except as hereinafter provided; and solar energy
collectors and equipment used for the mounting
or operation of such collectors.
b.
Places of public assembly in churches, schools
and other permitted
public and semi-public
buildings may exceed height limitations otherwise
established by this title; provided that these are
located on the ground floor of such buildings and
provided that for each one foot by which the
height of such building exceeds the maximum
height otherwise permitted in the district, its side
and rear yards shall be increased in width or
depth by an additional foot over the side and rear
yards required in the district.
c.
Elevator and stair
penthouses, water ta n ks,
monitors and scenery lofts are exempt from
height limitations otherwise established in this
title; provided that no linear dimension of any
such structure exceed fifty
percent of the
corresponding street frontage line.
d.
Towers and monuments, cooling towers, gas
holders or other
structures, where the
manufacturing process requires a greater height,
and grain elevators and silos are exempt from this
title; provided that any structure above the height
otherwise permitted in the district shall occupy no
more than twenty-five percent of the area of the
lot and shall be at least twenty-five feet from
every lot line."

Section 12
Repealer.
Ordinance No. 1472, an emergency zoning ordinance establishing a moratorium on the
approval and issuance of conditional use permits for personal wireless service facilities, and
Ordinance No. 1474, an emergency zoning ordinance establishing a moratorium on the approval
and issuance of conditional use permits for radio and television towers and antennas, and all
resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in conflict
herewith are hereby repealed.
Section 13
Severability.
If any provisions of this ordinance or the application thereof to any person or circumstances
is held invalid, such invalidity shall not affect the other provisions of this ordinance which may be
given effect without the invalid provision or application and, to this end, the provisions of this
ordinance are declared to be severable.
Section 14
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and assessments
that were incurred or proceedings that begun before the effective date of this ordinance.
Section 1 5
Effective Date.
This ordinance shall be in full force and effect on November 20, 1998.
