ORDINANCE NO. 1483
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "AS"
(AGRICULTURAL SUBURBAN) TO "R-O" (RESIDENTIAL--OFFICE) ON
32.444 ACRES DESCRIBED AS TRACT 2A-1, CERTIFICATE OF SURVEY
NO. 2029, SITUATED IN THE NORTHEAST ONE-QUARTER OF SECTION
23, TOWNSHIP 2 SOUTH, RANGE 5 EAST, MONTANA PRINCIPAL
MERIDIAN, GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment to amending the zoning designation
from "AS", Agricultural Suburban, to "R-O",
ResidentialnOffice, has been properly
submitted, reviewed and advertised; and
WHEREAS, the City-County Planning Board held a public hearing on September 5,
1998, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City-County Planning Board forwarded a recommendation to the
Bozeman City Commission that the requested zoning designation be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on
October 5, 1998, to receive and review all written and oral testimony on the request for a
zone map amendment; and
WHEREAS, the public hearing was continued to October 26, 1998, to allow for the
submittal of additional written and oral testimony; and
WHEREAS, the City Commission has reviewed and considered the twelve zone
change criteria established in Section 76-2-304, M.C.A., and found the proposed zone map
amendment, as recommended by the City-County Planning Board, to be in compliance with
the twelve criteria; and
WHEREAS, at its meeting held on October 26, 1998, the City Commission found
that the proposed zone map amendment would be in compliance with the Bozeman Area
Master Plan and would be in the public interest; and
WHEREAS, the subject parcel was described in the staff report and the Planning
Board resolution as "Tract 2A, Certificate of Survey No. 1969, situated in the N1 /2 of the
NE1/4 of Section 23, T2S, R5E, M.P.M., Gallatin County, Montana"; and the tract is more
specifically described as one of three tracts now comprising Certificate of Survey No. 2029.

NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of
Bozeman, Montana:
Section 1
That the zoning district designation of the following-described property is hereby
amended from "AS", Agricultural Suburban, to "R-O", Residential--Office:
Tract 2A-1, Certificate of Survey No, 2029, situated in the North one-half
of the Northeast one-quarter of Section 23, Township 2 South, Range 5
East, Montana Principal Meridian, Gallatin County, Montana.
Section 2
The effective date of this ordinance is January 25, 1999.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading,
at a regular session thereof held on the 7th day of December 1998.
