ORDINANCE NO. 1486
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING
THAT THE BOZEMAN MUNICIPAL CODE
BE
AMENDED BY REVISING SECTION 2.28.040; PROVIDING FOR REVISIONS TO
THE MANNER IN WHICH THE COMPENSATION OF THE CITY JUDGE IS
CALCULATED.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana, that
Section 1
That Section 2.28.040 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
"2.28.040 Compensation and expenses.
Tho s::Ilary of tho oity judge shall be paid monthl'l at a daily rate for oach judicial
day
thot the eity judge sholl preside over a scssion of city court or attends required training sesoions.
The d::Iily rate of compensation shall be determined b'{ dividing tho annual salary, as established
by the annual s::Ilory ordinance of the city, by two hundred sixty, representing the overage
number of worl<.ing da'{o in a YO::Ir, which daily rate sh::I1I then be multiplied by the number of
days each month that the eity judge actually prcsides over city court or attends required training

health insurance program, this position shall be considered one-half time.
In addition to the
salary, the city judge shall receive actual and necessary travel expenses in performing official
duties as provided by state law."
Section 2
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or

circumstances is held invalid, such invalidity shall not affect the other provisions of this
ordinance which may be given effect without the invalid provision or application and, to this end,
the provisions of this ordinance are declared to be severable.
Section 4
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that begun before the effective date of this
ordinance.
Section 5
Effective Date.
This ordinance shall be in full force and effect thirty days after final adoption.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at
a regular session thereof held on the 19th day of January 1999.
