ORDINANCE NO. 1488
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, PROVIDING THAT THE BOZEMAN
MUNICIPAL CODE, AS
AMENDED BY ORDINANCE
NO. 1463, WHICH
ORDINANCE IS NOT
CURRENTl Y CODIFIED, BE AMENDED BY REVISING SECTION 6.04.170;
PROVIDING FOR REVISIONS TO THE DUTIES, AUTHORITY AND POWER OF
THE ANIMAL CONTROL OFFICER.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana:
Section 1
That Section 6.04.170 of the Bozeman Municipal Code be amended so that such
section shall read as follows:
"6.04.170 Enforcement--Animal control officer authority.
For the purpose of discharging the duties imposed by this chapter and enforcing its
provisions, the animal control officer, or any police officer, in addition to any and all other

animal is kept or harbored, the exhibition of such animal and the license for
such animal.

until such time as a hearing can be held before the city court to determine
whether and under what conditions the animal should be released to the owner.

Section 2
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect the other provisions of this

ordinance which may be given effect without the invalid provision or application and, to this
end, the provisions of this ordinance are declared to be severable.
Section 4
Savings Provision.
This ordinance does not affect the rights or duties that matured, penalties and
assessments that were incurred or proceedings that were begun before the effective date
of this ordinance.
Section 5
Effective Date.
This ordinance shall be in full force and effect on April 1, 1999.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading
at a regular session thereof held on the 16th day of February 1999.
