ORDINANCE NO. 1502
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE
AMENDED BY REVISING SECTION 8.16.060, DELETING THE PROHIBITION
AGAINST BURNING SOLID WASTE TO ALIGN THIS SECTION OF THE
CODE WITH CHAPTER 8.44.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana that
Section 1
The Bozeman Municipal Code Section is hereby amended by revising Section
8.16.060 so that it reads as follows:
"8.16.060 Outdoor Burning or dumping of solid waste prohibited.
The outdoor burning of solid waste within the corporate limits of the city (except
by the deportment of public service pursuant to its operation under this chapter) in or out of
incinerators, and tholfi~ deposit of solid waste upon the premises or property of another
without the express permission and consent of the owner or occupant of such other property
or premises, is forbidden and prohibited, and any such burning or depositing shall be deemed
a violation of this chapter and, upon conviction in the city l~gJplp!! court, shall subject the
offender to the penalties provided for violetieAs hereof I~f,~~g::::~~~i::j:~~iptir. "
Section 2
Recealer
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts
thereof in conflict herewith are hereby repealed.
Section 3
Savin as Drovision
This ordinance does not affect the rights and duties that matured, penalties that
were incurred or proceedings that were begun before the effective date of this ordinance.
Section 4
Severabilitv
If any portion of this ordinance or the application thereof to any person or
circumstances is held invalid, such invalidity shall not affect other provisions of this
ordinance which may be given effect without the invalid provisions or application and, to this
end, the provisions of this ordinance are declared to be severable.

Section 5
Effective Date
This ordinance shall be in full force and effect thirty (30) days after final adoption.
