ORDINANCE NO. 1503
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "RS"
(RESIDENTIAL--SUBURBAN COUNTRY ESTATES DISTRICTJ
TO "R-1 "
(RESIDENTIAL..SINGLE-FAMILY, LOW-DENSITY DISTRICT) ON 2.574 ACRES
LOCATED IN THE EAST ONE-HALF OF THE EAST ONE-HALF OF THE
SOUTHWEST ONE-QUARTER OF SECTION 35, TOWNSHIP 1 SOUTH, RANGE
5 EAST, M.P.M., GALLATIN COUNTY, MONTANA.
WHEREAS, the proposed zone map amendment from "RS", Residential--Suburban
Country Estates District, to "R-1", Residential--Single-Family, Low-Density District, has been
properly submitted, reviewed and advertised; and
WHEREAS, the City-County Planning Board held a public hearing on April 20, 1999, to
receive and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City-County Planning Board recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on May 3,
1999, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment
to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on May 3, 1999, the City Commission found that the
proposed zone map amendment would be in compliance with the Bozeman Area Master Plan and
would be in the public interest upon annexation of the subject parcel; and
WHEREAS, the subject parcel was annexed through adoption of Commission Resolution
No. 3315, adopted on the 7th day of September 1999.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following-described property is hereby
amended from "RS" (Residential--Suburban Country Estates District) to "R-1" (Residential--
Single-Family, Low-Density District):
The Remainder of Baxter Lane Subdivision No.1, in the East one-half of the
East one~half of the Southwest one-quarter of Section 35, Township 1 South,

Range 5 East, Montana Principal Meridian, Gallatin County, Montana, and more
particularly described as follows:
Commencing at the S ~ corner of said Section 35, thence N45 0 24' 16"W a
distance of 42.18 feet to the intersection of the west right~of~way line of
Thomas Lane with the north right~of~way line of Baxter Lane, the true point of
beginning. Thence on said right~of~way line of Baxter Lane, 5890 16'00"W a
distance of 300.51 feet. Thence, leaving said north rightMof-way line,
NOoo05'30"W a distance of 373.05 feet to the southwest corner of Lot 7,
Baxter Lane Subdivision No.1. Thence N890 16'32"E a distance of 300.63
feet to the southeast corner of said Lot 7, being a point on the west right~of~
way line of Thomas Lane. Thence on said west
right~of-way line,
500004'31 "E a distance of 373.00 feet to the point of beginning.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at
a regular session thereof held on the 7th day of September 1999.
