BE IT ORDAINED by the City Commission of the City of Bozeman, Montana, that Section 1 That Section 15.36.010 of the Bozeman Municipal Code be amended so that such section shall read as follows: "15.36.010 Adoption bv reference of the Uniform Fire Code Uniform Fire Code Standards and Administrative Rules. A. The current edition of the Uniform Fire Code and appendices, and the Uniform Fire Code Standards, adopted by the Fire Prevention and Investigation Bureau of the Montana Department of Justice (or its successor), as set out in the Administrative Rules of Montana, and as amended from time to time by the Bureau, are adopted by reference and incorporated in this chapter as if set forth in full, with the additions, amendments, and deletions enumerated within the Administrative Rules. G Q' Any amendments adopted by the Fire Prevention and Investigation Bureau ~ .. ..::t:: :.:.:.:.:.:.:. which apply to local government jurisdictions, including the adoption of the latest editions of the Uniform Fire Code or applicable Administrative Rules of Montana, shall become effective in the City of Bozeman 90 days after the date the Bureau notifies the City of the amendments. G. E. A copy of the amendment notification will be kept in the office of the Clerk of the Commission. E. fh The Uniform Fire Code, Uniform Fire Code Standards and Administrative Rules ,;.:.:,:.;. of Montana, as adopted above, are applicable within the city limits of Bozeman." That all resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in conflict herewith are hereby repealed. Section 4 Savinas Provision. This ordinance does not affect the rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this Ordinance. - 2 * - Section 5 Severabilitv. If any portion of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions of this ordinance which may be given effect without the invalid provision or application and, to this end, the provisions of this ordinance are declared to be severable. Section 6 Effective Date. This ordinance shall be in full force and effect thirty (30) days after final adoption. NOTICE OF INTENTION TO ADOPT "CURRENT EDITION OF UNIFORM FIRE CODE" NOTICE IS HEREBY GIVEN that the City Commission of the City of Bozeman intends to consider final adoption of Ordinance No. 1511, adopting by reference the current edition of the "Uniform Fire Code" and appendices, and the Uniform Fire Code Standards, adopted by the Fire Prevention and Investigation Bureau of the Montana Department of Justice (or its successor), as set out in the Administrative Rules of Montana, and as amended from time to time by the Bureau, and Part 1.1 of Section 1 and Sections 2, 3, 4, and 5 of Appendix 1-A in their entirety, Appendix III - A and Appendix III - B at its regular meeting to be held at 3:00 p.m. on Monday, April 3, 2000. One copy of the 1997 Edition of the Uniform Fire Code is on file with the Clerk of the Commission of the City of Bozeman for inspection by the public. Incorporation of technical codes by reference (1) The governing body of an incorporated city or town may adopt technical building, zoning, health, electrical, fire, and plumbing codes in whole or in part by reference. (2) At least 15 davs Drior to final action by a governing body of the city or town, notice of intent to adopt a technical code in whole or in part by reference shall be published in a newspaper of general circulation in the city or town. A copy of the code or part to be adopted shall be filed with the clerk of the city or town for inspection by the public. (3) If a technical code or part of a code is adopted by reference, a record in "The Ordinance Book" may be made by recording the ordinance without setting forth the provisions of the code or part of a code adopted.
