ORDINANCE NO. 1519
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONT ANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS BY AMENDING THE ZONING DESIGNATION FROM "AS"
(AGRICULTURE SUBURBAN DISTRICT) TO "M-1" (LIGHT MANUFACTURING
DISTRICT) ON 18.906 ACRES LOCATED IN THE SOUTHWEST ONE-QUARTER
OF SECTION 36, TOWNSHIP 1 SOUTH, RANGE 5 EAST, P.M.M.. GALLATIN
COUNTY, MONT ANA.
WHEREAS, the proposed zone map amendment from "AS", Agriculture Suburban
District to "M.1", Light Manufacturing District, has been properly submitted, reviewed and
advertised; and
WHEREAS, the City Planning Board held a public hearing on Wednesday, June 2, 1999,
to receive and review all written and oral testimony on the request for a zone map amendment;
and
WHEREAS, the City Planning Board recommended to the Bozeman City Commission that
the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on
Wednesday, July 6, 1999, to receive and review all written and oral testimony on the request
for a zone map amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment,
to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on Tuesday, July 6, 1999, the City Commission found
that the proposed zone map amendment would be in compliance with the Bozeman Area Master
Plan and would be in the public interest, upon annexation of the subject parcel; and
WHEREAS, the subject parcel was annexed through adoption of Commission Resolution
No. 3364, adopted on the 5th day of June 2000.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:
Section 1
That the zoning district designation of the following.described property is hereby
amended from "AS" (Agriculture Suburban District) to "M-1" (Light Manufacturing District):
A tract of land being a portion of unplatted State of Montana Lands situated
in the SW~ of Section 36, Township 1 South, Range 5 East, M.P.M., Gallatin
County, Montana, and being further described as below:

Beginning at a point being the WY-. corner of said Section 36; Thence along
the east.west mid-section line of said Section 36 S89022'17"E a distance of
61.58 feet to a point on the westerly right-of-way line of Interstate Highway
90; Thence along said line along a non~tangent curve to the left with a radial
bearing of N83024'30"E and having a radius of 4407.50 feet to a distance of
2329.71 feet to the north line of the current M-1 zoning as shown on the City
of Bozeman Zoning map; Thence along said line S89043'52"W a distance of
927.00 feet to a point on the west line of said Section 36; Thence along said
line NOoo20'24"E to a distance of 2144.04 feet to the Point of Beginning.
Said Tract being 18.906 acres.
Section 2
The effective date is thirty days after final adoption of this ordinance on second reading.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading, at
a regular session thereof held on the 5th day of June 2000.
