Home My WebLink AboutOrdinance 00- 1528, Amends §§ 15.01.010, 15.04.010, 15.06.010 and 15.16.010, buildings and construction _~""'......_~~;,-_'~~ _"J_ ORDINANCE NO. 1528 AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONT ANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED BY REVISING SECTIONS 15.01.010 AND 15.01.020, 15.04.010, 15.05.010, 15.06.010, 15.07.010, 15.08.010, 15.12.010, 15.14.010, 15.16.010, 15.24.010, 15.30.010; FURTHER PROVIDING FOR THE ONGOING ADOPTION OF VARIOUS MODEL BUILDINGS, HOUSING AND TECHNICAL CODES AND THE ACCOMPANYING STATE ADMINISTRATIVE REGULATIONS, AND PROVIDING A PENALTY FOR VIOLATIONS. BE IT ORDAINED by the City Commission of the City of Bozeman, Montana: Section 1 That the Bozeman Municipal Code be amended by amending Section 15.01.010, to read as follows: "15.01.010 Adoption of the model technical codes and administrative rules. a. The current editions of the following model listed technical codes and all accompanying appendices, amendments and modifications adopted or required to be adopted by the Building Codes Bureau, Montana Department of Commerce (or its successor), as set out in the Administrative Rules of Montana, as amended from time to time by the Building Codes Bureau, are adopted by reference and incorporated in this Title as if set forth in full, except for any exceptions noted in this Chapter or any regulations not applicable to local government jurisdictions: 1. The "CABO One and Two Family Dwelling Code" published by the Council of American Building Official. 2. The "Model Energy Code" published by the Council of American Building Officials. 3. The "National Electrical Code" published by the National Fire Protection Association. 4. The "Uniform Building Code" and the "Uniform Building Code Standards" published by the International Conference of Building Officials*:~::~PpJ!~Bt,i!::~g::~!~;i9!~!~!QI!'B~~,ii;;;':*ijl:ptf:~::'i~ ~i~t9P,,:::1::~~iAA:::::9'f';~I)!::::gp!I9~t9i:~!!~lqg:::::~p~:i. 5. The "Uniform Code for the Abatement of Dangerous Buildings" published by the International Conference of Building Officials. 6. The "Uniform Code for Building Conservation" published by the International conference of Building Officials. 7. The "Uniform Housing Code" published by the International Conference of Building Officials. 8. The "Part II of the Uniform Federal Accessibility Standards" published by the General Services Administration, Washington, D.C. .- ., 9. The "Uniform Plumbing Code" published by the International Association of Plumbing and Mechanical Officials. b. One (1) copy of each Code shall be kept on file in the office of the Clerk of Commission of the City of Bozeman, 411 East Main Street, Bozeman, Montana and one (1) copy shall be kept on file in the offices of the Building and Planning office of the City of Bozeman, Montana. c. Any amendments adopted by the Building Codes Bureau which apply to local government jurisdictions including the adoption of the latest editions of the model technical codes or applicable Administrative Rules of Montana, shall become effective in the City of Bozeman 90 days after the date the Bureau notifies the City of the amendments. d. A copy of the amendment notification will be kept in the office of the Clerk of Commission. e. The Model Technical Codes and Administrative Rules of Montana as adopted above, and the other provisions of Title 15 are applicable within the City of Bozeman and within its extra- territorial building jurisdiction." Section 2 That Section 15.04.010 of the Bozeman Municipal Code be amended so that such section shall read as follows: "15.04.010 Uniform Building Code and the Uniform Building Code Standards. The Uniform Building Code, published by the International Conference of Building Officials, and the Uniform Building Code Standards, published by the International Conference of Building Officials, regulates the erection, construction, enlargement, alteration, repair, moving, removal, demolition, conversion, occupancy, equipment, use, height, area, and maintenance of all buildings and/or structures in the jurisdiction of the City; ~ria providing for the issuance of permits and .;.:.:.:.:.:.:.:.:.; collection of fees therefor." Section 3 That Section 15.06.010 of the Bozeman Municipal Code be deleted, as follows: "16.08.010 Part II af the Uniform FeEleral A.eeessibility Standards. Part II of the Uniform Federal Aooessibility Standards published by the Gcncr31 Servicc~ Administration, Washington, D.C. establishes minimum standards for facility aocessibility for physically handicapped persons." 2 __.. _, ,..___.____., __n ____ _ _ _._ __,. Section 4 That Section 15.16.010 of the Bozeman Municipal Code be amended so that such section shall read as follows: "15.16.010 Uniform Plumbing Code. The Uniform Plumbing Code, as published by the International Association of Plumbing and Mechanical Officials, regulates plumbing, g03 J}iJ)iAg and drainage systems." Section 5 Reoealer All resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in conflict herewith are hereby repealed. Section 6 Savinqs Provision This ordinance does not affect the rights and duties that matured, penalties that were incurred or proceedings that were begun before the effective date of this ordinance. Section 7 Severabilitv If any portion of this ordinance or the application thereof to any person or circumstances is held invalid, such invalidity shall not affect other provisions of this ordinance which may be given effect without the invalid provisions or application and, to this end, the provisions of this ordinance are declared to be severable. Section 8 This ordinance shall be in full force and effect thirty (30) days after final adoption.
