ORDINANCE NO. 1534
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN ZONE MAP'S ZONING DISTRICT
DESIGNATIONS TO ESTABLISH INITIAL ZONING DESIGNATIONS OF "R-O"
(RESIDENTIAL - OFFICE) ON 12.7251 ACRES AND "R-3" (RESIDENTIAL -
MEDIUM-DENSITY) ON 22.6499 ACRES lOCATED IN THE SOUTHWEST ONE-
QUARTER OF SECTION 1, TOWNSHIP 2 SOUTH, RANGE 5 EAST, PRINCIPAL
MERIDIAN OF MONTANA.
WHEREAS, the proposed zone map amendment to establish initial zoning designations of
"R-O", Residential-Office, and "R-3", Residential-Medium-density, has been properly submitted,
reviewed and advertised; and
WHEREAS, the City Planning Board held a public hearing on November 2, 1999 to receive
and review all written and oral testimony on the request for a zone map amendment; and
WHEREAS, the City Planning Board forwarded a recommendation to the Bozeman City
Commission that the requested zoning designation be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on November
15, 1999 to receive and review all written and oral t~stimony on the request for a zone map
amendment; and
WHEREAS, no individuals from the general public spoke in opposition to the zone map
amendment or expressed concern regarding appropriate land use patterns and balance of residential
types; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76-2-304, M.C.A., and found the proposed zone map amendment,
as recommended by the City Planning Board, to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on November 15, 1999, the City Commission found that
the proposed zone map amendment would be in compliance with the Bozeman Area Master Plan
and would be in the public interest upon annexation of the subject parcel; and
WHEREAS, the subject parcel was annexed through adoption of Commission Resolution
No. 3425, adopted on the 20th day of February 2001.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:

Section 1
That the zoning district designation of the following-described property is hereby initially
established as "R-O", Residential-Office:
A tract of land located in the Southwest one-quarter of Section 1, Township 2
South, Range 5 East, Principal Meridian of Montana, Gallatin County, Montana,
being further described as follows:
Commencing at the South one-quarter corner of said Section 1. Thence North
88058'57" West along the South line of said Southwest quarter of distance of
899.47 feet to the Southeast corner of the Walton Property. Thence North
00005'17" West along the westerly line of the Gallatin County Rest Home
property, as shown on the plat in Book 23 Misc., Page 50, a distance of
1753.52 feet to the True Point of Beginning, said point being the Southeast
corner of the property to be zoned R-O, Residential Office District.
Thence North 89031 '37" West, a distance of 617.95 feet. Thence North
02013'08"West along the easterly line of Steven's Subdivision, a distance of
874.97 feet. Thence South 89031 '37"East along the southerly right-of-way of
Oak Street, a distance of 650.48 feet. Thence South 00005'17"East along the
westerly line of the Gallatin County Rest Home property, a distance of 874.04
feet to the True Point of Beginning.
Said tract of land being 12.7251 acres along with and subject to any existing
easements.
Section 2
That the zoning district designation of the following-described property is hereby initially
established as "R-3", Residential-Medium-density:
A tract of land located in the Southwest one-quarter corner of Section 1,
Township 2 South, Range 5 East, Principal Meridian of Montana, Gallatin
County, Montana, and being further described as follows:
Commencing at the South one-quarter section of said Section 1. Thence North
88058'57"West along the South line of said Southwest quarter a distance of
899.4 7 feet to the Southeast corner of the Walton Property and the True Point
of Beginning, said point being the Southeast corner of the property to be zoned
R-3, Residential Medium Density District.
Thence North 88058'57" West along the South line of said Southwest one-
quarter, a distance of 183.33 feet. Thence North 02015'36" West along the
easterly line of a tract conveyed in Book 139, Page 515, a distance of 195.46
feet. Thence North 88058'57"West along the northerly line of said tract, a
distance of 183.20 feet. Thence South 02015'36" East along the westerly line
of said tract, a distance of 195.46 feet. Thence North 88058'57" West along
the South line of said Southwest one-quarter, a distance of 183.20 feet, Thence
along the easterly line of Homesites Subdivision the following two courses:
North 02015'36"West, a distance of 195.46 feet, thence North 02021'56"
West, a distance of 1203.65 feet. Thence North 02013'08" West along the
easterly line of Steven's Subdivision, a distance of 351.18 feet. Thence South
89031 '37"East, a distance of 617.95 feet. Thence South 00005' 17"East along
the westerly line of the Gallatin County Rest Home property, as shown on the
plat in Book 23 Misc., Page 50, a distance of 1753.52 feet to the True Point of
Beginning.

Said tract of land being 22.6499 acres along with and subject to any existing
easements.
Section 3
The effective date of this ordinance is thirty days after final adoption.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at a
regular session thereof held on the 26th day of February 2001.
