ORDINANCE NO. 1535
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, AMENDING THE BOZEMAN OFFICIAL ZONING MAP ZONING DISTRICT
DESIGNATIONS TO ESTABLISH INITIAL ZONING DESIGNATIONS OF nM.1" (LIGHT
MANUFACTURING) ON 22.44 ACRES, "R.O" (RESIDENTIAL-OFFICE) ON 31.72
ACRES, AND nR_3n (RESIDENTIAL-MEDIUM-DENSITY) ON 21.07 ACRES LYING
IN THE NORTHWEST ONE-QUARTER OF SECTION 35, TOWNSHIP 1 SOUTH,
RANGE 5 EAST, MONT ANA PRINCIPAL MERIDIAN,
GALLATIN COUNTY,
MONT ANA.
WHEREAS, the proposed zone map amendment to establish initial zoning designations of
"M~1 "(Light Manufacturing) on 22.44 acres, "R.O" (Residential-Office) on 31.72 acres, and "R-3"
(Residentia 1- Med i um~density) on 21.07 acres, has been properly submitted, reviewed and
advertised; and
WHEREAS, the City of Bozeman Zoning Commission held a public hearing on October 5,
1999, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City of Bozeman Zoning Commission recommended to the Bozeman City
Commission that the zone map amendment be approved; and
WHEREAS, after proper notice, the City Commission held its public hearing on November
1, 1999, to receive and review all written and oral testimony on the request for a zone map
amendment; and
WHEREAS, the City Commission has reviewed and considered the twelve zone change
criteria established in Section 76.2.304, M.C.A., and found the proposed zone map amendment,
to be in compliance with the twelve criteria; and
WHEREAS, at its meeting held on November 1, 1999, the City Commission found that the
proposed zone map amendment would be in compliance with the 1990 Bozeman Area Master Plan
Update and would be in the public interest, contingent upon annexation of the subject property
and amendment of the land use elements in the Master Plan; and
WHEREAS, the subject property was annexed through adoption of Commission Resolution
No. 3434, adopted on the 9th day of April 2001; and
WHEREAS, the land use designations were amended through adoption of Commission
Resolution No. 3435, adopted on the 9th day of April 2001.
NOW, THEREFORE, BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana:

Section 1
That the zoning district designation of the following-described property is hereby initially
established as "M-1" (Light Manufacturing).
A tract of land being a part of the Northwest Quarter of Section 35, Township 1
South, Range 5 East, P.M.M., Gallatin County, Montana, and being more particularly
described as follows:
Commencing at the center 1/4 corner of Section 35, Township 1 South, Range 5
East, P.M.M., Gallatin County, Montana; thence North 00.13'52" East, along the
north-south 1/4 line of said Section 35, a distance of 126.05 feet to the Point of
Beginning, said point being the point of curvature of a non-tangent curve to the left,
having: a radius of 300.00 feet, a central angle of 16.34'07", a chord bearing of
North 32'46'40" West and a chord length of 86.45 feet; thence along the arc of said
curve, an arc length of 86.75 feet to the point of tangency of said curve; thence
North 41'03'43" West, a distance of 470.98 feet to the point of curvature of a
curve to the right, having: a radius of 300.00 feet, a central angle of 41'17'35", a
chord bearing of North 20'24'56" West and a chord length of 211.56 feet; thence
along the arc of said curve, an arc length of 216.21 feet to the point of tangency of
said curve; thence North 00.13'52" East, parallel to and 432.50 feet westerly at
right angles from the said north.south 1/4 line of Section 35, a distance of 1902.19
feet; thence North 89'45'14" East, along the north line of Section 35, a distance of
432.51 feet; thence South 00.13'52" West, along the north-south 1/4 line of
Section 35, a distance of 2530.14 feet to the Point of Beginning. The described
tract contains 22.44 acres, more or less.
Section 2
That the zoning district designation of the following-described property is hereby initially
established as "R-O" (Residential Office).
A tract of land being a part of the Northwest Quarter of Section 35, Township 1
South, Range 5 East, P.M.M., Gallatin County, Montana, and being more particularly
described as follows:
Beginning at the center 1/4 corner of Section 35, Township 1 South, Range 5 East,
P.M.M., Gallatin County, Montana; thence South 89.41 '58" West, along the east-
west 1/4 line of said Section 35, a distance of 1126.15 feet; thence North
30.22' 19" West, a distance of 483.25 feet; thence North 59'37'41" East, a distance
of 87.36 feet;. thence North 30'22' 19" West, a distance of 32.50 feet; thence North
59'37'41" East, a distance of 452.23 feet to the point of curvature of a curve to the
right, having: a radius of 300.00 feet, a central angle of 30'31 '40", a chord bearing
of North 74.53'31" East and a chord length of 157.96 feet; thence along the arc of
said curve, an arc length of 159.84 feet to the point of tangency of said curve;
thence South 89'50'39" East, a distance of 6.90 feet; thence North 00'13'52" East,
a distance of 1899.86 feet; thence North 89'45'14" East, along the north line of
Section 35, a distance of 332.51 feet; thence South 00.13'52" West, parallel to and

radius of 300.00 feet, a central angle of 41.17'35", a chord bearing of South
20.24'56" East and a chord length of 211.56 feet; thence along the arc of said
curve, an arc length of 216.21 feet; thence South 41.03'43" East, a distance of
4 70.98 feet to the point of curvature of a curve to the right, having: a radius of
300.00 feet, a central angle of 16.34'07", a chord bearing of South 32.46'40" East
and a chord length of 86.45 feet; thence along the arc of said curve, an arc length
of 86.75 feet; thence South 00.13'52" West, a distance of 126.05 feet to the Point
of Beginning. The described tract contains 31.72 acres, more or less.

That the zoning district designation of the following-described property is hereby initially
established as "R-3" (Residential Medium Density).
A tract of land being a part of the Northwest Quarter of Section 35, Township 1
South, Range 5 East, P.M.M., Gallatin County, Montana, and being more particularly
described as follows:
Commencing at the north 1/4 corner of Section 35, Township 1 South, Range 5
East, P.M,M., Gallatin County, Montana; thence South 89.45'14" West, along the
north line of Section 35, a distance of 765.03 feet; thence South 00.13'52" West,
a distance of 830.43 feet to the Point of Beginning; thence South 00.13'52" West,
a distance of 1069.43 feet; thence North 89.50'39" West, a distance of 6.90 feet
to the point of curvature of a curve to the left, having: a radius of 300.00 feet, a
central angle of 30.31'40", a tangent length of 81.87 feet, a chord bearing of South
74.53'31" West and a chord length of 157.96 feet; thence along the arc of said
curve, an arc length of 159.84 feet to the point of tangency of said curve; thence
South 59.37'41" West, a distance of 452.23 feet; thence clockwise through the
following 9 courses:
North 30.22' 19" West, a distance of 32.50 feet;

Section 4
The effective date of this ordinance is thirty (30) days after second reading.
