ORDINANCE NO. 1547
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN.
MONT ANA. REPLACING THE EXISTING OFFICIAL ZONING MAP REFERENCED IN
CHAPTER 18.06 OF THE BOZEMAN MUNICIPAL CODE WITH A NEW OFFICIAL
ZONING MAP.
Preamble
This ordinance is to protect the public peace. property. health and safety through the
adoption of an official municipal zoning map as allowed in state law.
WHEREAS. on the 1 st day of May 2000. the City Commission adopted Ordinance No. 1513,
establishing a permanent municipal zoning ordinance in compliance with the requirements of
Section 76-2-301, M.C.A., et seq.; and
WHEREAS. said zoning ordinance was adopted as Title 18, Zoning. of the Bozeman
Municipal Code; and
WHEREAS. said Title 18, Bozeman Municipal Code, included an official zoning map; and
WHEREAS. Section 18.06.030 of the Bozeman Municipal Code provides a method by which
the official zoning map may be updated or replaced when it becomes damaged or difficult to
interpret because of the nature and number of changes; and
WHEREAS. the City has established a Geographic Information System which offers superior
means of maintaining a correct and accurate official zoning map; and
WHEREAS. the City wishes to permanently replace the existing official zoning map with a
newly drafted and updated official zoning map created by the use of the Geographic Information
System which will be the basis for all future updates and corrections to the official zoning map.
NOW. THEREFORE. BE IT ORDAINED by the City Commission of the City of Bozeman,
Montana, that:
Section 1
The official zoning map referenced in Chapter 18.06 Bozeman Municipal Code and
authorized by Section 76-2-302 Montana Code Annotated be replaced by a new official zoning map
and that such map shall be as follows:

Section 2
Repealer.
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof
in conflict herewith are hereby repealed.
Section 3
Severability.
If any provisions of this ordinance or the application thereof to any person or circumstances
is held invalid, such invalidity shall not affect the other provisions of this ordinance which may be
given effect without the invalid provision or application and, to this end, the provisions of this
ordinance are declared to be severable.
Section 4
Savings Provision.
This ordinance does not affect the rights of duties that matured, penalties and assessments
that were incurred or proceedings that begun before the effective date of this ordinance.
Section 5
Effective Date.
This ordinance shall be in full force and effect thirty (30) days after final adoption.
PASSED AND ADOPTED by the City Commission of the City of Bozeman, Montana, at a
regular session thereof held on the 10th day of September 2001.
