ORDINANCE NO. 1559
AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF BOZEMAN,
MONTANA, PROVIDING THAT THE BOZEMAN MUNICIPAL CODE BE AMENDED
BY REVISING SECTION 15.01.010; PROVIDING FOR THE ADOPTION OF THE
CURRENT EDITIONS OF THE VARIOUS MODEL BUILDING TECHNICAL CODES
BY ADMINISTRATIVE ORDER OF THE CITY MANAGER, AND PROVIDING A
PENAL TY FOR VIOLATIONS.
BE IT ORDAINED by the City Commission of the City of Bozeman, Montana:
Section 1
That the Bozeman Municipal Code be amended by amending Section 15.01.010, to read as
follows:
"15.01.010 Adoption of the model technical codes and administrative rules.
A. The current editions of the following model fisted technical codes.n)jr'\BJua~bYfOQtliroild
m:~:iQ.~!ng;:~R!Qm~!IJ;f;Jt~.nd.nlpfj@ni9iJ~ and all accompanying appendices, amendments and
modifications adopted or required to be adopted by the Building Codes Bureau, Montana Department
of Commerce (or its successor), as set out in the Administrative Rules of Montana, as amended from
time to time by the Building Codes Bureau, are adopted by reference and incorporated in this Title as if
set forth in full, except for any exceptions noted in this Chapter or any regulations not applicable to local
government jurisdictions. :-
1. The "CADO Onc and Two ramil)' Dwelling Code" published by thc Council
of American Ouilding Official.
2. The "Model [ner-gy Code" published by the Council of Amcrican Building
Officials.
3. Thc "National [Iectrical Code" publishcd by the National rire rrotection
Association.
4. The "Uniform Duilding Code" and the "Uniform OUilding Code Standards"
publishcd by the International Conference of Ouilding Officials, applicable to all
buildings unless exemptcd by Section 106.2 of the Uniform Ouilding Code.
5. The "Uniform Code for the Abatement of Dangerous Ouildings" published
by the International Conference of Ouilding Officials.
6. The "Uniform Code for Building Conser'1ation" published by thc
International conference of Ouilding Officials.
7. The "Uniform I lousing Code" published by the International Confcrence of
Ouilding Officials.
8. The ''raft II of the Uniform reder-al Acccssibility Ctandards" published by
the Gcncral Services Administration, Washington, D.C.
9. The "Uniform Mechanical Code" published by the Intcrnational Conference
of Ouilding Officials. Gas piping systems installed in accordance with the Uf'liform

Mechanicsl Code shall include water heaters af1d boilers installed per the Uf1iferm
rlumbin9 Code.
10. The "Uniform rlumbin9 Code" publishcd by the IntcFflational Association
of rlumbin9 and Mcchanicsl Officials.
B. One (1) copy of each Code shall be kept on file in the office of the Clerk of
Commission of the City of Bozeman, 411 East Main Street, Bozeman, Montana and one (1) copy shall
be kept on file in the offices of the Building and Planning office of the City of Bozeman, Montana.
C. Any amendments adopted by the Building Codes Bureau which apply to local
government jurisdictions including the adoption of the latest editions of the model technical codesfJ&

Rules of Montana, shall become effective in the city 80 days after the date the burcau notifics the city

i!ffective' date is specified .Inthe Administrative Order.
D. A copy of the amendment notification will be kept in the office of the Clerk of
Commission.
E. The Model Technical Codes and Administrative Rules of Montana as adopted above,
and the other provisions of Title 15 are applicable within the City of Bozeman and within its extra-
territorial building jurisdiction."
Section 2
All resolutions, ordinances and sections of the Bozeman Municipal Code and parts thereof in
conflict herewith are hereby repealed.
Section 3
SavinQs Provision
This ordinance does not affect the rights and duties that matured, penalties that were incurred
or proceedings that were begun before the effective date of this ordinance.
Section 4
Severabilitv
If any portion of this ordinance or the application thereof to any person or circumstances is held
invalid, such invalidity shall not affect other provisions of this ordinance which may be given effect without
the invalid provisions or application and, to this end, the provisions of this ordinance are declared to be
severable.

Section 5
This ordinance shall be in full force and effect thirty (30) days after final adoption.
PASSED by the City Commission of the City of Bozeman, Montana, on first reading at a regular
session thereof held on the 25th day of February 2002.
