HomeMy WebLinkAboutContinuation of Preliminary Decision on Selection of Investigator for Hiring Practices Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Greg Sullivan, City Attorney SUBJECT: Decision on Preliminary Selection of Investigator (Final Decision to be made on July 27, 2009). MEETING DATE: July 20, 2009 AGENDA ITEM TYPE: Regular Agenda RECOMMENDATION: Make Decision on Preliminary Selection of Investigator. BACKGROUND: Last Monday, July 13, 2009, you requested additional information regarding a list of preferred contractors. Specifically, by motion, you requested “some initial pricing information.” I contacted each of the candidates on your list and provide the following: Anne MacIntyre: Ann stated she will charge $100.00 per hour to conduct interviews or other work related to the investigation, including writing any report, and for travel time between the Helena valley and Bozeman. She will charge for vehicle use, too. Ms. MacIntyre has never worked for or on behalf of the City of Bozeman. Michelle Puiggari: Michelle will charge $80.00 per hour for time spent conducting the investigation and $30.00 per hour for travel to and from Missoula. Travel expenses and hotel expenses will also be charged. If follow up discussions can be had via telephone, Michelle stated that travel time and hotel charges can be minimized. Ms. Puiggari has never worked for or on behalf of the City of Bozeman. Jim Nys: Jim stated he charges $120.00 per hour for the time spent conducting the investigation, compiling the report, and presenting the report to the Commission, if required. He does not charge for copying unless the Commission requires a significant volume of reports. He does not charge for vehicle mileage. Mr. Nys has provided services to the City of Bozeman in the past in the capacity of interviewing employees and providing a report to the Human Resources Director regarding personality conflicts between certain employees. I believe Mr. Nys’s previous work for the city does not constitute a conflict of interest for conducting the investigation. 321 Cynthia Walker and Don Robinson: Ms. Walker and Mr. Robinson have withdrawn from consideration. FISCAL EFFECTS: As stated in my memo to you of July 13, 2009, the fiscal effects of hiring an investigator are currently unknown and will depend to a large extent upon the final scope of work and the hourly rate of the selected contractor and thus will be determined at the time a final contract is entered into by the Commission.
