E.Consent 1.Authorize Payment of Claims (LaMeres) 2.Authorize City Manager to sign Release and Reconveyance of Easement for West Winds Subdivision Phase 5 – (West Winds Master Homeowners’ Association, Inc.) (Stodola) 3.Authorize City Manager to sign Closing Documents-Condominium Declaration and Bylaws for Public Safety Condominiums, Fire Station Unit (Shrauger ) 4.Approve a Liquor License for 18 Miles to The Border to sell Beer and Wine at 131 West Main Street (Neibauer) *Consider a motion approving Consent Items E. 1-4 as listed above. Update on the Status of the Bogert Band Shell (White) Bozeman City Commission Agenda, July 13, 2009 H.Action Items 1. Compliance Review for Halfway (Recovery) House Conditional Use Permit No. Z-08070 located at 119 South Church Avenue (Shelly Johnson, Director of Alcohol and Drug Services of Gallatin Valley/Epple) *Review compliance of Halfway (Recovery) House Conditional Use Permit at 119 South Church Avenue. AND *Consider renewing the Halfway (Recovery) House Conditional Use Permit and Certificate of Appropriateness No. Z-08070 as conditionally approved by the City Commission with no further review required. 2. West Winds Major Subdivision Phases 4 & 5 Street Variance–Breeze Lane No. P-09005 (Epple) *Consider a motion approving the West Winds Major Subdivision Phases 4 & 5 Street Variance-Breeze Lane No. P-09005 with the conditions listed in the Staff Report. 3. Story Mansion Wedding Fee Changes and Approval of Resolution No. 4176, Amended Fee Schedule for the Rental of the Story Mansion (Mayor Jacobson) * Consider a motion amending the Commission’s motion from June 8, 2009 following: “It was moved by Cr. Becker, seconded by Cr. Rupp that the facility be reduced to 1 wedding per weekend, but the renter has to pay the full rate, no reduction, for (1) day and (2) ½ days which equals two days; the night before, the day of, and the next morning, so that they can set up, have the wedding, and cleanup and have an appropriate amount of time, at a $3,400 minimum rental. The motion passed 3-2 with Cr. Krauss and Bryson opposed. Cr. Becker later clarified that it does not matter what day of the week the Mansion is rented for a wedding, the fee would be for the night before, the day of, and the morning after.” AND * Consider a motion approving Resolution No. 4176, amending the Fee Schedule for the Rental of the Story Mansion, as amended. 4. Decision on Preliminary Proposed Scope of Work Related to Outside Investigation of Various City Hiring Practices and Preliminary Selection of Final Decisions to be Made on July 20, 2009 Investigator () (Sullivan) 2 Bozeman City Commission Agenda, July 13, 2009 *Consider a motion adopting Preliminary Scope of Work Related to Outside Investigation of Various City Hiring Practices. Montana Commercial Lease Agreement with Gallatin County To Lease 1710 square feet within the Law & Justice Center for Second Municipal Court (Winn) *Consider a motion authorizing the City Manager to sign the Montana Commercial Lease Agreement with Gallatin County to Lease 1710 Square Feet within the Law & Justice Center for a Second Municipal Court subject to minimal changes for final legal review. 6. Re-appointment to the Northeast Urban Renewal Board (Kissel) one member *Consider a motion reappointing to the Northeast Urban Renewal Board.
