SUBJECT: Story Mansion Wedding Fee Changes and Approval of Resolution
No. 4176, Amended Fee Schedule for the Rental of the Story Mansion
MEETING DATE: July 13, 2009
RECOMMENDATION:
1. Consider a motion amending the Commission’s motion from June 8, 2009 following:
“It was moved by Cr. Becker, seconded by Cr. Rupp that the facility be reduced to 1 wedding per
weekend, but the renter has to pay the full rate, no reduction, for (1) day and (2) ½ days which equals
two days; the night before, the day of, and the next morning, so that they can set up, have the
wedding, and cleanup and have an appropriate amount of time, at a $3,400 minimum rental. The
motion passed 3-2 with Cr. Krauss and Bryson opposed. Cr. Becker later clarified that it does not
matter what day of the week the Mansion is rented for a wedding, the fee would be for the night
before, the day of, and the morning after.”
AND
2. Consider a motion approving Resolution No. 4176, Amending the Fee Schedule for the Rental of
the Story Mansion, as amended.
BACKGROUND: At the Regular City Commission Meeting on June 8, 2009, The Commission made
amendments to the Story Mansion Fee Schedule as follows:
· “It was moved by Cr. Rupp, seconded by Cr. Becker to amend Resolution No. 4156 and impose
the hourly rate of $15.00 per hour for the library room. The motion passed 4-1 with Cr.
Krauss opposed.”
· “It was moved by Cr. Becker, seconded by Cr. Rupp that the facility be reduced to 1 wedding
per weekend, but the renter has to pay the full rate, no reduction, for (1) day and (2) ½ days

· Attorney Sullivan stated that the new fee schedule will go into effect the day that the new
Resolution is signed.
City Clerk Stacy Ulmen incorporated the changes into a new Resolution but at the Mayor’s request it
has not been added to the agenda for final approval. Mayor Jacobson stated at the July 6, 2009 City
Commission Meeting during FYI that she is adding the Story Mansion Wedding Fees to the Agenda for
July 13, 2009. The Commission directed staff to look into the proper procedure to do so. Following is
what has been determined as the proper process:
Discussion took place at the City Commission Meeting on June 8, 2009, that it was thought that a
Motion to reconsider would be needed. According to 2.04.260 Rules of Debate, Section D. 1 “A motion
to reconsider any action taken by the Commission must be made on the day such action. It must be made
either immediately during the same session, or at a recessed and reconvened session thereof.”
Because Mayor Jacobson is requesting this item be on the agenda for the meeting on July 13, 2009, the
above does not provide the proper procedure.
According to The City Commission Rules of Procedure, 2.04.160 Rules of Debate, Section D. 2 states:
“Nothing herein shall be construed to prevent any Commissioner from making or remaking the same or
any other motion at a subsequent meeting of the Commission, but the matter must be an agenda item.
Staff has determined that the proper process is to follow Robert’s Rules of Procedure to amend
something previously adopted, and also follow the Commission Rules of Procedure, 2.04.160 Rules
of Debate, Section D. 2.
ALTERNATIVES: As suggested by the City Commission.

COMMISSION RESOLUTION NO. 4176
A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF
BOZEMAN, MONTANA, AMENDING THE FEE SCHEDULE FOR
RENTAL OF THE STORY MANSION.
WHEREAS, the Park and Recreation Director had submitted a recommendation
for establishment of Story Mansion rental fees; and
WHEREAS, the City Commission found that it is in the best interest of the City
to establish reasonable fees for use of the Story Mansion to offset a portion of the cost of
maintenance; and
WHEREAS , Resolution No. 4156, Establishing a Fee Schedule for the Rental of
the Story Mansion was approved by the City Commission at their Regular City
Commission on March 23, 2009; and
WHEREAS, the City Commission at their Regular City Commission Meeting on
Monday, June 8, 2009 made a motion to amend Resolution No. 4156, and made
Amendments to the Fee Schedule for the Rental of the Story Mansion;
NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City
of Bozeman, Montana:

· Cleaning and Damage Deposit is 50% of the rental fee, due at the time of
reservation. Damages and cleaning will be deducted from deposit. “Entire first
floor” reservation cancelations must be received a minimum of 60 days prior to
event for full refund.
· Full Day – 9am to 11pm (All outdoor activities must cease by 9 p.m.)
· Half Days – 9am to 4pm and 5pm to 11pm (All outdoor activities must cease by
9 p.m.)
· Holidays for computing rates are; New Years Eve/ New Years Day/ Memorial
Day/ July 4/ Labor Day/ Halloween/ Christmas Eve/ Christmas
· Non-City Resident fees – additional 20%
· City of Bozeman and Uses Beneficial to Story Mansion and grounds- No charge
· Other Government and Non-Profit Organizations – 50% discount
· No set up or staff provided. Clean up is the responsibility of renter and must be
completed at the conclusion of event.
· A Security Guard is required for events with 75 or more people and where alcohol
is served.
· Only outdoor activities at the Mansion that may be considered for lasting beyond
9 p.m. are community events approved by the City Commission through a Special
Temporary Use Permit.
Section 2
The fee schedule shall be effective immediately upon passage of this resolution.
All fees will be ½ of the price listed on the fee schedule through June 30, 2010, excluding
the Library and Wedding Events. On July 1, 2010 the fees will go to the full price as
listed in the fee schedule incorporated herein.
PASSED AND ADOPTED by the City Commission of the City of Bozeman,
Montana, at a regular and stated session thereof held on the 13th day of July, 2009
