HomeMy WebLinkAboutResolution No. 4178, Soroptomist Park Declaration Commission Memorandum REPORT TO: Honorable Mayor and City Commission FROM: Chris Kukulski, City Manager Andy Epple, Director of Planning SUBJECT: Soroptomist Park Declaration – Commission Resolution No. 4178 MEETING DATE: July 6, 2009 BACKGROUND: Soroptomist Park was not dedicated to the public through a subdivision platting process. Earlier this year the Commission expressed an interest in formally declaring Soroptomist Park public parkland as a means of conferring upon it status similar to that enjoyed by dedicated parks. Resolution 4178 would do so, verifying its status as public parkland and putting future Commissions and members of the public on notice that it is the expressed will of the current Commission that Soroptomist Park be maintained and managed as a public park in perpetuity. RECOMMENDATION: That the Commission adopt Resolution No. 4178. FISCAL EFFECTS: None identified. ALTERNATIVES: As suggested by the City Commission. Report compiled: July 1, 2009 365 COMMISSION RESOLUTION NO. 4178 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF BOZEMAN, MONTANA, REGARDING A TRACT OF LAND COMMONLY KNOWN AS SOROPTOMIST PARK, BEING 0.2271 ACRES IN SIZE AND CONSISTING OF LOTS 16, 17, AND 18, BLOCK C, ORIGINAL TOWNSITE PLAT OF BOZEMAN CITY, DECLARING SAID TRACT OF LAND TO BE PUBLIC PARK LAND. WHEREAS, The subject property is owned by the City of Bozeman; and WHEREAS, Section 7-16-4101 Montana Codes Annotated authorizes municipalities to establish, alter, and maintain parks; and WHEREAS, The subject property has been developed and maintained by the City of Bozeman as public parkland; and WHEREAS, The subject property is utilized by the public extensively and exclusively for park purposes; and WHEREAS, The subject property was not formally dedicated as parkland through a subdivision and platting process; and WHEREAS, The Commission finds that formally declaring Soroptomist Park public parkland would be in the community’s best interest, to help ensure that the property continues to be owned by the public and managed as public parkland; and WHEREAS, Formally declaring Soroptomist Park public parkland would advance the goals and objectives of the adopted Parks, Open Space and Trails (PROST) Plan, which states the City’s parks, recreation programs, and facilities, open spaces and trails play a vital role in defining Bozeman as “the most livable place;” 366 NOW, THEREFORE, BE IT RESOLVED by the City Commission of the City of Bozeman, Montana: Section 1: That pursuant to Section 7-16-4101 MCA, Soroptomist Park, as described above and as shown on Exhibit A (attached), is hereby established as public parkland to be utilized by the citizens of the City of Bozeman, Montana pursuant to and consistent with various ordinances of the City of Bozeman. Section 2: That City of Bozeman staff shall take such steps as necessary to ensure a public record of this action is recorded with the Clerk and Recorder’s office of Gallatin County, Montana, so that this Declaration of Parkland is known to all men and women as the will of the City Commission of the City of Bozeman, Montana.
